Just up the way from Neverland, where a sad A-merry-can tragedy is playing itself out, another A-merry-can tragedy has already taken place. You have probably never heard of Eric Frimpong; and honestly, if I hadn't decided to pick up my latest addition of ESPN The Magazine, I probably wouldn't have either. (That's surprising because I am a huge soccer fan.)
What happened to Eric Frimpong, on its face, seems sad and unconscionable. But unlike the people in the Duke case, who were quick to jump to the defense of the Dukies and tar and feather their accuser, I will reserve judgement on his guilt or innocence until I learn even more. (BTW, why have the people who were so vocal during the Duke case, been so silent during this one?That's a rhetorical question. I already know the answer)
The facts of this case sound all too familiar to some of us here in A-merry-ca; we have been down this road before. But I want to be fair to all concerned: The criminal justice system; the accuser; her friends; Fripong's lawyers; the jurors; Everybody. I want you to read the article for yourself and tell me what you think.
I will give you a little of it, but please go to the link at the end of the post and finish reading. It gets better. Or, I should probably say, worse.
"It's March 3, 2008, a brilliant day in Santa Barbara. But for Eric Frimpong, it feels like hell. He's in Superior Court, encircled by sheriff's deputies, making one more trip to the Department 2 courtroom. This is his last stop on the outside for a while, a painful reminder of how far he has fallen. He left his native Ghana in 2005 to play soccer for UC Santa Barbara; a year later he became a campus hero while leading the Gauchos to their first-ever national championship. If the immigrant experience can have a sound, Frimpong's sound was a raucous stadium. But in 2007, just weeks after being selected by the Kansas City Wizards in the MLS draft, he was accused of raping another student on the beach near his house. Now he's a convicted felon.
Frimpong enters the courtroom, which is packed with students and parents, former teammates and coaches -- row upon row of supporters. They've come for the sentencing that concludes a trial that has rocked this community: People v. Eric Frimpong. Or more accurately, People v. Eric Frimpong and His People.

A victim's advocate reads a statement on behalf of the accuser, referred to in this story and in news coverage throughout the trial as Jane Doe. "I don't care that he's a soccer star…and I'm a nobody," the statement says. "Eric Frimpong ruined my life."
There's a rumble in the gallery. If his supporters could chime in now, they'd say that the kid in the prison garb has never spoken an unkind word or acted aggressively toward anyone. They would remind the court of the points made at trial: that his accuser was a woman with little memory of what happened that night because of a near-toxic blood alcohol level; that Frimpong's DNA wasn't found on the victim; that semen found on her underwear belonged to a jealous boyfriend, a white student who was never a suspect. They would argue that overzealous law enforcement was determined to nail a high-profile athlete, facts be damned, and that this was the Duke lacrosse case all over again -- except that the defendants in the Duke case were white men from affluent families with the means to navigate America's justice system, unlike Frimpong, who is poor and an immigrant.
Judge Brian Hill, citing Frimpong's clean record and "a lot of community support," delivers his sentence: six years in state prison. As Frimpong is led away, many people in the gallery are crying. Out in the hall, Paul and Loni Monahan stand solemnly while the courtroom empties. Their son, Pat, was Frimpong's teammate, and the Monahans -- a white, middle-class family -- had embraced "Frimmer" like a son and a brother. Loni distributes copies of a printed statement: "We will continue to fight for Eric. We will not rest until he is exonerated and the ugly truth of his wrongful prosecution and conviction comes out." When the leaflets are gone, she leans against a wall, tears flowing. "Eric believed in our system," she says. "He believed justice would prevail." Then she straightens. "Before I was sad," she says. "Now I'm mad."
Something good happened in Santa Barbara. Even now, as Frimpong sits behind a glass partition in the visitors' room of a California jail, he smiles easily while talking about where he's come from and what he has achieved. The way he sees it, he has always been fortunate.
Back in Ghana, in western Africa, he and his three younger siblings were raised by their mother, Mary, in the poor farming community of Abesin, but her job as a typist with the government forestry department allowed the family to have plumbing and electricity, unlike many of their neighbors. Eric was an engineering major and a midfielder for Kwame Nkrumah University of Science and Technology, in Kumasi, when he caught the eye of UCSB assistant Leo Chappel, who attended a 2005 match to scout the son of a Ghanian pro but ended up offering a scholarship to Frimpong instead. The first words out of Frimpong's mouth? Thank God. The next: What's UCSB?
By that August, the Gauchos had a crafty midfielder with intangibles to burn. Frimpong's intelligence, instinct and vision, along with his speed and touch, made him an on-the-ball force. He also had a winning personality. "Frimmer was very humble and considerate, on and off the field," says head coach Tim Vom Steeg.
As a senior the next year, the 5'6" Frimpong developed a reputation as a lockdown defender in leading the unseeded Big West champs to a string of improbable NCAA tournament wins. When the final whistle blew on the 2006 national championship game, the Cinderella Gauchos had defeated four-time king UCLA. Frimpong earned All-Big West honors, a spot in the MLS supplemental draft and the gratitude of his peers. "He was the heart and soul of the team," says Pat Monahan. "Eric won us that championship."
Everyone around Frimpong was buoyed by his success: his mother, friends and classmates, prominent locals who had helped him out along the way with invites to dinner, rides to the store and, when he struggled with homesickness during his junior year, a fund-raiser that yielded $3,000 for a ticket to Ghana. "We all tried to pitch in, because Eric's so darn likable," says Tim Foley, a booster who made Frimpong a regular guest at his family's home. "He was an American success story."
The Monahans were especially proud. Frimpong had met his "American parents" on move-in day in 2005, and they promptly invited him to spend Thanksgiving in San Diego. They gave him his first cell phone and laptop and took him on family vacations. They sat in their kitchen for hours listening to his stories about Ghana. They were also impressed by his knowledge of the Bible, and his quiet spirituality helped bolster their own faith. "He was going to graduate, play professionally, make more money here than he ever could in Ghana and bring it back to support his family," Loni says. "Eric really had it all."
With the support of friends, including girlfriend Prieto (far right), Frimpong stayed in school after the incident and graduated.
Something bad happened in Santa Barbara. On Feb. 17, 2007, sometime after midnight on a fast-eroding bluff of beach right below 6547 Del Playa Drive, Jane Doe was raped. She said Eric Frimpong did it, and an all-white jury agreed. But the nature of the case, and some of the more slippery details surrounding it, has divided the community, raising questions about the reliability of the victim's memory, the true character of the accused, the motives and tactics of law enforcement, even the fairness of the justice system. Amid all the controversy, though, two simple truths remain: A young woman was victimized, and a young man's dream was shattered.
UCSB is among the nation's top party schools, and oceanfront Del Playa is the belly of the beast. Even a model student-athlete like Frimpong, who maintained a 3.0 GPA while working on a double major in applied mathematics and business economics, found it hard to skip the party entirely. After the Gauchos won it all, they were the toast of the town, especially Frimmer. As Pat Monahan puts it, "You'd walk into apartments and see Ghanian flags hanging over people's beds."
Frimpong's journey from soccer hero to convicted felon began a little more than halfway through his senior year. (The account that follows is based on police reports, interview transcripts, court proceedings and comments from trial observers.) The night of Feb. 16 began for Frimpong in the same place where he started most Friday nights, on the couch in his house at 6547 Del Playa Drive, watching a movie with housemates. His girlfriend, Yesenia Prieto, was working late, but Eric had reason to celebrate, fresh off an impressive 10-day tryout for the Wizards, so he showered and went to meet friends at a party at 6681 Del Playa Drive. It was outside that home, at about 11:30 p.m., that Frimpong met Jane Doe, a UCSB freshman. They struck up a conversation, then walked back to his house to play beer pong. They arrived just before midnight, and Eric introduced Jane to his roommates before taking her to the patio, where the two of them played beer pong for a few minutes until, according to Frimpong, Doe said she wanted to smoke, so they headed for the park next door. At the park, he says, Doe approached another male, who appeared to have followed them. When she walked back to Frimpong, she started kissing him, but he wasn't interested because she smelled of cigarettes. Doe became aggressive, he says, and stuck her hand down his pants. He pushed her away, then headed to the home of his friend, Krystal Giang, who'd been expecting him. By 4 a.m., he was in bed at Prieto's apartment.
About an hour and a half earlier, Jane Doe, accompanied by her sister and two friends, checked into Goleta Valley Cottage Hospital emergency clinic, claiming she had been raped...."

Sounds like what they did to my Uncle who was lynched in DeQuincy Louisiana in the 1920's. But at least the sham of due process occurred for Mr. Frimpong. What a damned shame. He oughta get another trial. Period.

And finally, the defense attorney, who said "'The best defense was no defense, because it would demonstrate there's nothing to defend," is grounds for appeal (ineffectual counsel).

This poor young man got screwed by all of the players whose job it is to prevent something like this from happening. I can only hope his appeals attorney knows what he is doing.
This is frightening. Really and truely frightening. To think that one could have their life literally ruined on such flimsy evidence seems absolutely ridiculous.

Yet, this young man's life has been ruined because of someone's bad choice, although I cannot figure out if the bad choice was his or hers or both.
But I guess prosecuters needed to send someone to jail. And the unknown black man with the white eyes(?), big lips, and exotic island accent fit the narrative. I only hope that in the end, the truth will emerge whatever that truth may be.

1. If a black woman makes a rape accusation, where her attacker is white, her credibility is assailed and her story is combed for inconsistencies. Whereas, if a white woman accuses a black man of rape, her credibility remains intact, despite gross inconsistencies.
2. DNA can exonerate a black man, whereas it will exonerate a white man.
3. Money buys the best justice.
And another thing... what kind of lousy ass lawyer would have his client in a friggin prison jump suit throughout his trial!!??? FUCKING INEFFECTIVE COUNSEL!! Ok now I am pissed. I HATE bad defense lawyers. They are the equivalent of a loaded gun that harms way too many people.

ReplyDeleteIt's a shame a promising young man's future has been taken away by false accusations. After reading the entire article it seems clear that they had very little evidence to convict and that the Judge was clearly a racist bigot.
I can only pray that an appeals court will overturn this ruling and set Eric Frimprong free!

To be accused of rape by a white woman, if you're a black male, usually trumps all the evidence to the contrary.

This was certainly not a jury of his peers--What was it: nine white women and three white men?
That in itself was a travesty, and when you throw in the judge, and his rulings, and the sheriff's department questionable attitude:
"From the start, the sheriff's department felt like they had their guy. But when the evidence didn't turn out the way it was supposed to, their position became, 'If she's willing to testify, we'll go forward.' "
And her boy friend, Benjamin Randall's behavior was, at the least, suspect: he sees his girl friend with a black man, and he directly returns to his dorm, albeit upset, and, later, his semen--and only his semen--is found on the victim.
Boy, that's one gullible jury, or one hell-bent on finding a black man guilty of the supposed crime.
Boy what I'd give to be a fly on the wall in that deliberation room!

ReplyDeleteJody, aren't these lawyers one of the reasons that the legal profession has a bad rap? I am not saying ALL lawyers are incompetent, and certainly not implying that you are, but I have heard so many complaints about incompetent useless lawyers who don't give a damn about their clients.
Considering it's Cali, where racism runs amuck, a black person accused of rape in Santa Barbara had better have some lawyer with the skills of Johnny Cochran defending him!

It had oil on it, but you know they not telling that part. They claimed they didn't know what happened. He was a preacher. However, the family knew what it was about. Now to be fair, I am not sure what stage of the trial that picture was from. The jury might not have been present in the court room. Still, the prison jump suit is troubling as well.

It's been that way for centuries and more often than not, the black male is found guilty(hung) Especially when it's an all white jury. California is well-known for its all white jury verdict involving a black man.

ReplyDeleteFirst, I am not a lawyer, I am a legal worker who works for, in my opinion, one of the best criminal defense attorneys in Philadelphia. He wins amazing cases is how I know that is a fact, plus he is a fighter. He does not push his clients into accepting deals. I am also a legal rights activist, a member of a legal collective that does know your rights trainings and does volunteer work with various groups around criminal justice issues.
To answer your question... the legal profession is like most professions.. there are plenty of competent people who do their job. There are some who are stand outs and do great jobs, and then there are those who are lazy, or just not very good at what they are doing.
In this case, this poor kid had a hat trick, a trifecta of bad lawyers.
For Christ's sake, not this bullshit. When I got raped, I knew I didn't stand a chance in court because of lack of evidence and racism. Some white bitch gets semen that is not even the accused's on her body and she gets "Justice". God....I hate america.

I'm not even a lawyer and I could have did a better job than both his own lawyer and the DA in the case did.
I think I'll send out an e-mail ALERT TO BLACK FOLKS warning them not to use that lawyer for anything. That's something to think about. Blacks need to stop using these lawyers that don't have their interest at heart and spread the word about them. If they can take your money and charge you and an arm and leg, they should at least do a good job defending you. If they don't want to do that, well, word of mouth still travels fast, e-mails, and telephone would be busy to make sure that they don't get any other unsuspecting black person's money.

Hmmm...I wonder if she is getting ready to become a Fox News Commentator and taking Shep's place since I know that Roger Ailes is probably hotter than fish grease at him for not going along with the program. This is really, really sad. Talk about a dream deferred. Just think: he went ahead to graduate, and when this is all over he'll be deported back to Ghana. I mean that's it; no vindication what so ever should by some miracle this ruling is overturned. He'll be kicked out of the country.

Field, this story appears to be a ridiculous miscarriage of justice. Except it's not funny, it's heartbreaking.
Reminds me of that movie where the black man was going to college to be a doctor and was accused falsely and sent to prison. He eventually got out. It also reminds me of a true story of a young man named Timothy Cole who was convicted of a rape crime he didn't do. He was exonerated later on after he had already died in prison.
ReplyDeleteI think about this young man whose family is in Ghana and he is out here all alone with no family near by to support him, only the support of a few friends. He is going through a horrible ordeal right now. I wonder how he views America's justice now? A justice system that he had more faith in than it's own citizens do. I pray that the Lord shines the light on his case and that he will be freed from terrible ordeal.

IMHO, the "legal system" is what's wrong with this country, espeically as it relates to the medical profession.
How else do you explain, from a statistically point of view, the fact that Black men make up the majority population in prisons, but only ~10% of the national population.

When I read about the dismissal of the teeth mark evidence, Ted Bundy came to mind. His bite marks definitely linked him to one his victims. And the fact that DNA evidence, or lace thereof, was disregarded is reprehensible.

That is plausible. Some folks are speculating that she is preparing for a 2012 run for the White House. I think that is less plausible, since a fair percentage of voters do not like irratic behaviour. Does a governor quitting his/her elected office constitute irratic behavior?

ReplyDelete1. What about the victim's epithelial tissue found on Eric's penis, scrotum and under his fingernails? Yeah, it did not have any vaginal cells. But how did it get there? Eric says the victim grabbed his penis while making advances. I guess others say that she grabbed it to repel an attack.
2. Was the victim asked if her assailant wore a condom? If so, that could be why none of his DNA was found on her. However, I find it hard for a man to rape a woman and leave no trace evidence on her.
3. Is this case an exact parallel of the Duke case. I say no. In all fairness to the Duke defendants, NO DNA from Mangum was found on any of the defendants.
fly.... I disagree with your point on resign v quit. Those men and women who "resigned" did so because they were "forced" out due to behavior (either illegal, unethical, or immoral according to their constituents). Resignation in politics has always connoted forced out.
ReplyDeletePalin, on the other hand, chose to quit. While she has often been the target of criticism (mostly self inflicted), lots of politicians are the targets of daily criticism, but rarely do they quit in mid term because of it. They may choose not to run again, but they don't quit.
This is, of course, if you accept on face value, the reason she quit was because of the attacks on her. I personally think in the next few days we are going to be hearing about indictments.... thus, she jumped ahead to control the spin of her leaving.
In any case, if it does prove that she quit because of criticism, then she does not belong in politics, fair or unfair....
This is not a gender issue.
I am so disgusted by this case!! The blatant racism makes my blood boil. Thanks for bringing light to this injustice field. Now what are we going to do about it. Let's not just comment on this issue, fellow readers. We should join his supporters, write letters, or at least spread the word. Commentary isn't enough in this day and age.

I have a country mate that is serving the same amount of time for hitting his white girlfriend. She accused him of rape too.
We can excuse this guy as a naive immigrant but I have seen Black American men, especially in colleges, put themselves in situations ripe for such incidents.
Like I said before as long as Black men keep on with the White/light woman worshipping, these women will always feel a certain power over you and can accuse one of anything they please and the powerful white man will always run to their rescue because it keeps him relevant.
I feel sorry for the guy. He can only be rescued by well meaning white people in Santa Barbara who seemed charmed by his "uniqueness". As an African immigrant, I doubt Black America will put in that much effort for him.
This should be a good cautionary tale for African men in America.

ReplyDeleteFrimpong needs to have a decent lawyer who will first, get a stay on his sentance so that he can be freed while this case is on appeal.
Next, while I feel sorry that the woman was raped, she is not a credible witness, given that she was intoxicated and admits to having no memory.
Frimpongs lawyer,yes, incompetent, and just allowing his client to wear a prison suit is proof.
The physical evidence alone, exonerates Frimpong.
Next, we have prosecutorial misconduct as exculpatory evidence was withheld in the case of the expert witness accounts on the teeth marks. Plus, it is not even credible that an expert witness wouldn't charge a fee. This aspect alone, should have a least rendered a mistrial.
Finally, the judge could have either called for a mistrial, OR, set aside the jury verdict, at least in NY that would be possible, I don't know California law.
Frimpong did not get a jury of his peers, a jurist wasn't dismissed, even though she was arrested for dwi while sitting on the jury, the evidence points to a jealous boyfriend as well as exonerates the defendant, there was prosecutorial misconduct, and the judges rulings were biased. Frimpong needs to be released now, not waiting for an appeal.
I took this excerpt from the link about the teeth evidence:
"Perhaps the most troubling ruling, as far as the defense was concerned, involved bite mark analysis. The prosecution's forensic expert, Norman Sperber, testified that he couldn't rule out Frimpong for causing the bite on Jane Doe's face. But detectives failed to disclose that they had first approached another expert: Raymond Johansen would later testify, outside the jury's presence, that after preliminary analysis, he told Kies that the bite mark was "vague." Law enforcement is required to turn over evidence that doesn't point to the defendant as the suspect; suppressing such evidence is grounds for a mistrial. But Kies failed to file a report of his conversation with Johansen. When questioned by Sanger, the detective stated that while he had indeed approached Johansen first, the dentist had failed to provide any opinion. Kies and senior DA Ronald Zonen both told the court that they had passed over Johansen because he wanted to charge for his services, and Sperber wasn't charging. But Sperber testified that he always charges for his services, and he did so for this case, too. Judge Hill, who had served 19 years as a Santa Barbara DA prior to sitting on the bench, ruled that Johansen's testimony was not exculpatory and denied that motion as well."

Even if Frimpong were a Black American, Blacks wouldn't stand up for him, unless Rev Al got involved. Oh, I forgot. There are Blacks who have a problem with Rev Al being in the news lately with the Jackson family and speaking out in support of MJ. They think he should step aside.
Of course there is no one else to step up to the plate but that doesn't matter to some black Americans. We'd rather be weak and defenseless than to have Rev Al or JJ involved. I am sure racist Whites are happy about that.

This is a calculated miscarriage of justice. The white girl lied and she knows it. I am not a lawyer but the case is a mob action against an upstanding young man. Eric found out the hard way that lady justice in America has two offsprings, one white and the other is black.

Same here though I didn't realize his GF was not Black. If she is white, then his interests and resources are not geered to the BC and therefore is not entitled to their support.
BM have to learn that marrying or dating white does not absolve one from community responsibility. But since they do it to get away, if they get into trouble then the community should not be expected to come to their rescue.

Really? Light skinned BM are less likely to be stopped by COPS than darker skinned men. I have a neighbor that got entangled in a messy divorce and custody battle and he believes the wife was given special treatment because she was light skinned.
I think we should be honest about Light skinned privilage. I am amazed at how much denial there is to this. The denial is worse than Whites denying their white privilage. Very few light skinned blacks will ever admit that they benefit from being lighter skinned. Michael Dyson amazingly told of his light skin privilage growing up which put him at an advantage over his darker skinned brother. That is the only person I have heard being honest about the issue.
And for the record among my people we have an even distribution of both and light skin is not valued over dark. Infact there is a certain darkness that treasured more than light skin. They belief True beauty is not light.

What I take issue with is the fact that not ONE black man commenting on this post has acknowledged the fact cheating on their girlfriend/wife led to the demise of both Eric and Steve. Being Black isn't what hurt Eric or Steve, their

ReplyDeleteThe fact is that I don't know a Black woman alive who hasn't at some point in her dating life, been cheated on by a Black man. And I'm talking about women who have never been married to women who have been married for 50+ years.
I love a Black man and love them in general. But that doesn't absolve me from keeping it real when it comes to their significant part in the destruction of the Black community. I'm old school, and I belive that familes should be led by men. Of course the only problem with that in Black families is that Black men don't seem to hang around long enough to lead. Or perhaps the desire to support and nurture the familes they create simply skeets ouf of them at the moment of orgasm.

The Book "Why Black men love White women" is an eye openner and it confirms what I always suspected. Most of these guys are in those relationships for the wrong reasons. And BW have every right to be mad at them even if they personally are not attracted to them. I for one have stated many times, I have no interest whatsoever in American Black men. So why am I really angry?
And this "why are Black women angry about these relationships" is getting really old. The attention is always diverted to the "angry" Black woman and not the issue of the society ills being created by this behavior by Black men.

I feel very, very bad for Eric. Even if he was a horrible person, it is really hard to believe that his DNA would not be found on the victims body even if he did rape her. Even if he used a condom (as a another poster pointed out), then the prosecution should have had the burden of coming up with the used condom or explaining the lack of his seminal fluids by the presence of latex or lubricants in the victims vaginal cavity. His semen may not have left a trail, but the condom would have. But the burden of proof should have been on the prosecution, not a bunch of posters on this site.

BW today largely date out as a necessity. BM will start out looking for the lighter ones and as they go higher gravitate towards white. And we still live in the old world where the men pursue women. So BW don't have much of a choice but to go with those willing to date them who sometimes are WM.
When a BW gets herself any man we applaud. The BM only get applauded when he gets something closer to White.
So the two are not equal at all and can not be argued the same way.

To illustrate my point: There is a “columnist” that poses publicly as a lover of black women, yet he regularly curses and vulgarly libels me in emails as no other black male hater I have ever endured. I am adept at ignoring such juvenile wannabees. I will continue to ignore him because he is insignificant enough to ignore.
But, I can never ignore all of the significant “brothers” who disrespect me and my sisters in all media daily. “Brothers” like Eddie Murphy, R. Kelly (When is he ever going to trial?!?), Snoop Dogg, 50 Cent, and countless other “brothers” who incessantly slander us as “skeezers, skanks, tricks, bitches, hos, hood rats etc...”. Asians and Whites go to grad school LOOKING for someone to marry before they finish so they can slowly build wealth and their families along the way. Black men go to grad school, their egos swell because they are one of a very few black men in grad school, then they decide to get their "playa, playa" on instead of trying to settle down. When they are between the ages of 35-40, they decide to settle down with a woman between the ages of 23-30 and/or one that isn't Black. Black male medical students are even worse.

As has been pointed out, everyone in the system has failed him. In the end, they've failed the young woman too by directing her to the wrong person while her real attacker remains free.
Hopefully, the coverage will help Mr. Frimpong. I know I'll be pulling for him.
