"The law is an ass"


I think Mr. Bumbles meant that the Law-yer is an ass.

Stay with me. I am giving you the following little anecdote for a reason.

Today I am getting on the elevator on my plantation with an African American security officer who works with me. There was a well dressed young lady (she seemed to be in her early thirties) in the lobby with us, and she walked behind us to the elevator. The guard and I got on, but girlfriend stopped short. The guard, to his credit, held the door open, looked out at her, and asked her if she was going up. (The elevator only went up, we were on the first floor and this elevator does not go down.) The poor child got on and seemed both embarrassed and terrified at the same time. Face pressed against the door; never looking back even once; even when the guard tried to make small talk with her. (Oh field, stop it, maybe the poor girl was afraid of elevators. Ever though of that Mr. Racism Chaser? ) So anywhooo, turns out the young lady was a lawyer and she was going to my floor to have a hearing in front of one of my colleagues. -I was kind of hoping it was me.- Hey, not that I would not have been fair to her client. Unlike Radio Rwanda, I really am "fair and balanced". I never let personal biases or outside influences affect my decisions. Strictly by the book for the kid. It just would have been interesting, that's all I am saying.

So I tell this story about this young lawyer to tell you another one about future lawyers at one of A-merry-ca's finest legal institutions. Sadly, my friends, even those among us who are supposed to be "enlightened" can't seem to shake themselves from the shackles of bigotry and ignorance.

The following *article is by Kashmir Hill writing for AboveTheLaw.com:

"Every time you put something into an email, please remember that someone you send it to may hit Forward. If your email makes the case for a biological reason for racial disparities in intelligence, someone might hit Forward and send it to Black Law Student Associations across the nation.

That’s what happened to a Harvard 3L yesterday. We’ll call this 3L CRIMSON DNA. According to our sources, DNA made some controversial comments about race at a dinner held by the school’s Federalist Society. CORRECTION: This dinner was not an official Fed Soc dinner. [FN1]

After the dinner, DNA felt the need to send an email to a few friends clarifying those views. Here’s an excerpt:

'I absolutely do not rule out the possibility that African Americans are, on average, genetically predisposed to be less intelligent. I could also obviously be convinced that by controlling for the right variables, we would see that they are, in fact, as intelligent as white people under the same circumstances. The fact is, some things are genetic. African Americans tend to have darker skin. Irish people are more likely to have red hair.'

One of the 3Ls to receive that email, available in full after the jump, was very upset by it. We’ll call this student CRIMSON OUTRAGE. OUTRAGE arranged for the email to be sent out to the Harvard Black Law Student Association list-serv, including DNA’s name and the fact that after graduation, the author will be doing a federal clerkship.

After that, the email went viral, apparently circulating to BLSAs across the country. There are now plans to try to go after DNA’s clerkship….

We got the email multiple times last night, from lots of first-time tipsters horrified that a person at Harvard Law School with a federal clerkship offer in hand holds such views. The person sending out the email to the Harvard BLSA wrote:

I am saddened that a current HLS student holds such antagonistic and archaic views about our people and that the potential impact of her ignorance is only strengthened by her prestigious affiliations and credentials." [Article here]

A "federal clerkship"? Oh Lawd! O man, please do not select that Judge this person will be clerking for to the supremes. Although, to be honest, I bet they would feel right at home in Washington.

    This crap is from a Harvard student. I wonder, what was Dipshit DNA's educational background prior to law school? I certainly didn't include much science.

  8. I'd like to know the name of the judge she is suppose to have a federal clerkship with,if he/she knows how this girl thinks, and if they are of the same opinion.

    People of color already have to deal with the lopsided scales of lady justice. Woe unto people of color if they have to deal with her. Smh!

    I'll say, some of these white folks need to get over themselves. Evidently, she doesn't know any blacks folks other than the mugshots that MSM loves to highlight and bombard us with.

  9. Devil's advocate: When you fwd an email, most email programs allow you to alter the text.

    I'm just saying that to say I don't usually take fwd emails that seriously. But I do believe this one is legit. This does not surprise me. There are people who actually think black people are genetically less intelligent. Even some whites who so willingly accept that the human race all started out black and in Africa. I don't trust some of them either. On the same token they can use that very theory for their argument by saying they "evolved" and we didn't. You can't win with some of them.

    As for Ms. elevator, I once experienced a white male literally grabbing his white girlfriend closer to him for dear life as I walked going the opposite direction to them. It was a huge hotel hallway and there was plenty of room between us for a full car pass through. It's like he did it as if he thought there would be "trouble" if she so much had caused wind to brush up on my elbow, or as if I would have knocked her down for walking close to me, like I was some kind of female brute.

    I hate how ignorant bigots can make you feel sometimes.

    You know it's so important to confront our biases and try to remove them...and one of my biases has always been stupid white people...

    It's difficult for me to remove these biases when you read somethig like this....

    There are, what? 200 Million WHITE FOLKS in this country.

    If we subtract out the White women who are dating or married to a Black man JUST IMAGINE what would happen if YOU were triggered to respond to something that some WHITE PERSON said that offended you Granny.

    If you were forced to individually address an e-mail to all 200 Million WHITE FOLKS - you would be one busy soul.

    I am not sure "confronting biases" is as important as DEMANDING scientific and transparent PROOF, reminding this person that since he/she is in an ELITE, Euro-centric center of learning that the Ivy League is that they should be committed to a higher level of evidentiary standard than which is allowed in the LESSER schools that many who support Affirmative Action for admissions into these elite, mostly White schools, turn their noses up at.

    I can't understand why this person would ever think that any Black people believe in the constructs of "superiority and inferiority". What does he/she read? "The Crisis" magazine as the model to learn about Black folks and our damaged state due to Slavery?

    And you can appparently read the minds of young female lawyers? Nevermind the fact that if there is one thing females need to fear in A-merry-ca, it's black males. Maybe not ones in $900 suits or security service uniforms, but fear of black males is certainly rational. And perhaps being on an elevator with you is not such a treat. I'm sure that chip on your shoulder is probably more apparent than you think.

  21. Harvard harbors racist students despite reaching out to poor minorities. A very well known physics professor has publicly declared that women and ethnic minorities (along with some Jews) are not as intelligent as white people. I won't link to him because I don't want traffic to go to his site but he's a real asshole and he has POWER over grading students of color who take his courses etc. Similarly when someone like this gal who is going to be in a policy enforcement and interpretation position shows their biases along racial lines, clearly she is not fit to be an arbitrator of justice in any sense.

    How sad.

    However, I also concur with CF. This person is a total nobody whose function seems to be to remind us that academic racism is still alive and well...I suppose.

    Evidence for what? There was no explanation of what "DNA's" original comments were, only that they were offensive to the recipients. It is not my claim that blacks are superior or not, only that certain topics and opinions are taboo. I do not ascribe to the one statement acredited to the offender, but I certainly believe that it is at least possible that there are statisticaly significant differences between distinct genetic populations for any number of traits. And that an institution of higher learning should not hold that there are beliefs that need to defined as heresy.

    You are quite the empty suit, and I am not here to entertain pretentious phonies. Play on with the other poseurs. Good night Gregory.

  23. Anonymous, you are certainly right that some topics are taboo in academic literature. Intelligence is one such topic. One reason, though, is how it is defined or NOT. Differing populations place value on different things and IQ tests still have bias. I took the Adult IQ test I think it was called Weischler test or something a few years back. They showed me a picture of a boat and asked me to label its parts. Although I'd been sailing and my husband showed me what the parts of the boat were called, I drew a blank because I don't sail on a normal basis. I also wondered about people who had absolutely NO idea what the part of the boat was called but that were not unintelligent by any means.

    Before intelligence can even be quantified, it has to be defined all must universally agree on its definition.

    I find it interesting how Mozart is viewed as a musical genius but Duke Ellington and Billy Eckstine are deemed talented musicians. The only thing that separates these geniuses is their ethnic background because all three men were wonderful composers and musicians. I think there is a strong societal bias when it comes to the words intelligent and smartness.

    Do you, on the other hand, see the several assumptions inherent in your post?

    First, you imply that Granny, unlike you, doesn't define herself by her intellect.

    Second, you imply that one's intellect should predominate in one's self-definition.

    Third, you imply that you know the level of significance with which Granny viewed the "e-mail".

    Third, with no more proof than that which you concocted "between [your] two ears," you concluded that white folks have power over Granny.

    You used Granny's response to one e-mail, and made several untenable assumptions regarding how she develops her self-definition, the extent with which she regarded the e-mail, and the power that all whites have over her.

    You can't presume for Granny. You can only presume for yourself.

    Maybe this is my CONSCIOUS PREDISPOSITION at work Koan. (Now you have me motivated to go an pull up an ASCII chart and figure out that 'o' character. Damn - then I have to figure out the key combination on how to produce it in Windows)

    You see Koan I was on a conference call today with mostly WHITE FOLKS. I have two WHITE FOLKS on team along with a guy from Vietnam. We gave a dry run through of a presentation prior to releasing it. The panel of critics said that it was crap. An all WHITE panel criticized ME and my team!!

    I had to ARCH MY BACK to these WHITE FOLKS and tell them that THEY DIDN'T KNOW WHAT THE HELL THEY WERE TALKING ABOUT!!

    While it was true that two of my team members screwed up and did not emphasize the points that they were coached upon and thus gave the impression that was felt by the board - the bottom line was that it was up to ME - a Black man who WILL PUNCH MELLANEOUS IN THE NOSE IF HE CALLED ME "The Least Of These" to my face to DEFEND MY POSITION to these WHITE FOLKS who stood in judgment of ME through the content that was presented!!!!

    At the end of the session I told my team where they had screwed up in the delivery and how we had 3 weeks to get ourselves together. I later received an e-mail from the WHITE FOLKS on the panel telling us that we needed to make the changes per the statements DEFENDING our position in the "constructive feedback" session. I got them to back down because I did not allow them to run over ME. (Especially the snarky gay guy but it is not his sexual orientation that matters)

    Now Koan: Just imagine if I allowed my KNOWLEDGE OF THE CONTENT OF THIS IMPORTANT PRESENTATION to be solely judged on this "White Death Panel's" opinions? If, a Black man, allowed the "Least Of These" inferiorities that some believe I should cleave to to color my interaction with these WHITE FOLKS? The people on my team and everyone on the call listening in would have sensed that I was putty in their hands and that someone else's OPINION was enough to DEFINE ME!!!! They would have made us start totally over and possibly found a "less pigmented person" with "more intellect" to take the lead.

    I stand by my words Kaon. Though this narrative above was "all about ME" the fact is that it is relevant to this discussion. I can't be bothered with the IRRATIONAL notion that I need to constantly CHASE AFTER someone who is a NOBODY besides their white azzed skin!!

    This is INSANE.

    I REFUSE to be looked upon as the "Talented Tenth". In fact I REJECT this notion lumped upon us by WEB DuBois. (Come on man, the guy supported Woodrow Wilson and figured that this racist from Virginia was going to bring hope and change to Black folks as president).

    The Talented Tenth leaves 55% in the middle who go with the flow and then an "Inferior Least of These 35%" at the bottom.

    I told you before to only ask of ME what you would ask of any nondescript brother in Southwest Philly when you ask ME the question "What have YOU DONE in the community lately?". I will do no more for my RACE than you gin up the nerve to ASK HIM that same question for HE TOO is a member and has one "Black vote" as I do. (That is unless you believe Laurel and accept that I am a White guy sitting in Idaho who is passing).

  32. It seems to me that intelligence as defined by race is always being discussed. In fact there has been a perfected pseudo scientific argument that all threatened white folks trot out; anytime it seems like the play on "black folks don't do well in schools" is shot down or just one of them might lose their privilege.
    It is so tiresome for me, because it is not my job to educate ignorant white folk and not only is it tiresome it is downright impossible. That is why I think black folk are hesitant to engage in this so called debate.

    I'm not sure why this actually gained national coverage. This is not news. Many people feel this way, especially those in elite institutions. I've been in elite institutions all my life. I'm really not sure why people are "shocked, just shocked I say."

    Not one of these "injuries" can be sustained by the racist. They're only "sustainable" to the degree that we believe the war is winnable, or is a lost cause.

    Too many of us feel that the war is lost, and have given up "winning" for short-term success--power, money, prestige, what have you--by aiding and abetting the enemy, or by being co-opted, or by going over to the other side.

    Where you err, is that you believe that you can win the war with the weapons at your disposal.

    These weapons provide the appearance of success at the expense of real success--where we, as a people, are exercising real autonomy over our actions, leading to favorable outcomes, not only for the short-term, but for the indefinite future.

    It's more likely you need to check the history books for evidence -- actually, the absence of evidence -- of black academic achievement.

    In science there are virtually NO black names. Physics? Zero. Chemistry? Zero. Mathematics? Zero.

    Moreover, when it comes to Nobel Prizes in science, math and economics, only one prize has been won by a black. One winner in Economics. That's it.

    AS I said, IQ tests have limited value. The real test resulst are found in the record of achievement.

    When it comes to the intellectual factors that are foundation of prospering countries, those factors are found in white and asian countries, but not in black or muslim countries.

    One group suffers as a result of its devotion to the hoax of a religion and the other suffers from something that looks like it is genetic.

    The surest proof of racism in sports is the fact that today, in most sports, most of the records are held by blacks who had previously been unfairly blocked from participation.

    In the game of brains, if blacks are equal to whites and asians, then we should see real-world proof.

    The best proof would appear in the form of a black nation with an advancing, knowledge-driven economy.

    Inasmuch as Nigeria has the oil to finance education and everything else, by now it should have become the Norway of Africa. Instead, it is a mess where half the people are still waiting for indoor plumbing and electricity.

    I saw a National Geographic program recently, entitled, "The Search for Adam."

    It's a must see. It may be featured on the NatGeo site, or it may show up as a re-run from time to time.

    The conclusion: Adam, or what is also referred to as Genetic Adam, or Scientific Adam (the one man from whom all others stem, and from whom we have all inherited our Y Chromosome), originated in Africa, and was black, making us all relatives, regardless of color or culture.

    For every upside of technology, there's a downside.

    Texting has become Sexting, and all of it is being done while driving, with the resulting death count going up yearly.

    Social Networking has devolved at times into cyberbulling, and the luring of the young into the predatory hands of adults.

    And the list goes on!

    No, keep your technology. Let's return to simpler times, if they ever existed, and put humans above things, and return power to the people, all the people, and not corporations, and the super-rich.

    Let's pursue a spiritual agenda, rather than a material one.

    Not only would the people of the world be physically, emotionally, and mentally healthier for it, they wouldn't have a need for a technology that we haven't advanced spiritually far enough to use in our best interest, but against it.

    Check again. Driving deaths are down over the last few years. US driving deaths were around 42,000 a year for a long time. But in the last few years, the total has slipped below 40,000.

    Whereas, in Africa, most sub-Saharan nations have AIDS/HIV infection rates running from 10% to 25%. The population of all the affected nations is about 650 million. Even if the infection rate were only 10%, there would be 70 MILLION cases in those countries.

    Meanwhile, in Africa the AIDS/HIV problem is getting worse. Not better. Why? Because too few people believe the facts about the transmission of the infection.

    As for conquering various diseases -- yes, in the US and Europe we have conquered the death-by-dirty water problem.

    But in your zest to pretend otherwise, you ignore the difference between a public health problem best attacked through government management of water supplies with an individual health problem, such as cancer, best tackled in other ways.

    AIDS, meanwhile, is self-inflicted BUT easily preventable. Lung cancer is another self-inflicted, easily preventable disease that arrives as a result of a bad life-style choice.

    Bottom line, in Africa the governments of incapable of managing large-scale public health programs -- like providing clean drinking water to entire populations. The same governments fail to educate people about how to avoid AIDS and those same governments are incapable of treating multitudes of people who suffer from many illnesses that have been eradicated in the leading nations of the world.

    Once again, if blacks were equal to whites, then somewhere in the world there would be a black nation that enjoys prosperity similar to the prosperity found in the world's leading nations, and that black nation would prosper for the same knowledge-driven reasons.

    However, if Africa had been colonized with the same results, many African nations would enjoy similar prosperity. Therefore, it seems to me you believe colonaialism can work remarkably well.

    It is obvious to me -- a person with an engineering degree -- that you know absolutely nothing about the topics you mentioned, which means you cannot engage in a meaningful discussion about them.

    As for having nuclear weapons -- same story as guns. If nuclear weapons are outlawed, only outlaws will have them. Hence, no nation that has nuclear weapons today will destroy them and leave the nuclear club.

    Moreover, nothing except a military assault will stop Iran from developing nuclear weapons. Interestingly, even though Iran intends to hit Israel with a nuclear attack AND Israel will respond with a nuclear counter-punch, the Iranians continue to develop their bomb.

    In other words, they have already acknowledged their acceptance of mass death of Iranians as a price the leadership is willing to pay for the chance to strike Israel.

    Seems to me a conventional bombing run to destroy the Iranian nuclear facilities is the strategy that will reduce deaths all around.

    It's the idiocy of Islam that drives the Iranians.

There are people with a Ph.D. (such as yours truly) who couldn't survive a day in the desert because they have no relevant practical knowledge...and people who could survive who don't know how to read.

    So yeah, the wingnuts can claim they're being persecuted for daring to ask the question about race and intelligence, but in fact the question is meaningless. The FIRST thing you have to learn when you do research is how to frame an "answerable" question. The race-and-intelligence "question" isn't one of them.

    The letter clearly says that she finds the evidence for black intelligence to be inferior inconclusive and she can see either case.
    Here is the reality, intelligence is thought to be a little more than 50-60% genetic, this is largely based on twin studies of twins raised apart, in different houses.

    The issue is the other 40-50% we really have not identified all the various factors that affect intelligence.

    Another issue is that we don't know how malleable intelligence is in adults or children. Can intelligence be increased? If so, how much? Can that increase be maintained over time.

    As far as cultural bias, that is nonsense.

    The most accurate test use no words at all. It is called: Raven's Progressive Matrices

    All the major IQ tests correlate, not only with each other but with the SAT, GRE, GMAT, however, some might be better indicators than others.

    In any case if they were culturally bias, how is it that East Asians score higher than whites, about 50% of East Asians were not born in this nation and the one's who are often have immigrant parents. They have even tested people in Japan, China, and Korea, they still test higher than the average white.

    White folks made a test that is only bias against blacks and makes them [whites] look inferior [to Asians] on purpose? Doubtful. African Americans have a much closer cultural connection to white Americans than anyone in Japan has to a white American, that is certain. So I don't buy the cultural bias thing.

    What I believe is what the American psychological association states, black folks do have lower IQ's than whites (and Asians).

    THe issue is not that, no one really argues that.

    The issue is "what does that mean" in reality, in daily functioning?

    Is this static of flexible?

    WHat environmental factors could causes this and if they are identified how much is the variation if they are changed in adults and children (could be that after a certain age, like many things, you can't really change things easily with the human brain, but in children might be possible).

    I have also taken an IQ test myself, administered by a grad student from the Psych department at my university when I was a grad student (in another department), my IQ (like most grad students) was significantly higher than the average of 100.

    As far as women, women and men score about the same, with men doing slightly better on visual spatial skills. But "slightly" is only about 3-4 points, which does not seem to be a lot, but at the margins of a Bell Curve it could be significant when you are looking for women to excel in math and science in an academic setting, their will naturally be less than men, on top of that women have social factors (child birth and care) which make it harder to compete with male colleges (which I consider unfair, but it exists).

    So someone stating that on average women score slightly lower on IQ tests than men may or may not be a bigot, but their statement is TRUE.

    I have also read that women's IQ is less variable than men, meaning if the average is about 100, more people will group around 100, where men will have more really smart and really dumb people.

    Since we have not identified the vast majority of genes that deal with intelligence (maybe 100's) we don't know, but that suggest something in the X Chromosome. Men only have one, women have two, maybe the fact women have two modify and 'averages" things more. That's conjecture.

    I think intelligence is generally framed in a few ways:

    Ability to understand increasingly complex things

    Problem solving ability

    Memory

    How fast you can recall, solve problems, etc.

    So in a way it is the ability to think fast, problem solve, and regurgitate information quickly at increasing levels of difficulty.

    There is no test for creativity though, so someone can be very "intelligent" on an IQ test and do all these things, but not produce ONE THING NEW OF VALUE.

    That to me is a big gap.

  110. We have measured our mental capacities in a million ways for the last century. Clearly all our measuring has taught us a few things.

    Average IQs have some meaning. They tell us about groups.

    As for creativity and testing, well, yes, there are tests, but the real test for creativity is not a test. It is evidenced by creating something.

    When it comes to women and mathematics, there may be a number of women with PhDs in math, but there are NO major mathematical figures who are female. The high end of mathematics has always been a men's club.

    If women want to change things, they have to start breaking new mathematical ground. Complaining about bias in university math departments is a silly diversion from something that appears to be a biological difference between male and female brains.

    No-slap: I agree with you in that mathematics does not require massive amounts of research funding (well not compared to some other areas of study) women can make strides in it even if they are not backed up well by their university departments, but the women who have (historically) are few and far between.

    It is interesting though, one of Einstein's initials advisers and proof-readers was his first wife, a fellow student. However, he wanted her to be a housewife and not teach or do anything else. Although this is not 1910, we can't ignore social dynamics, although I don't think they are the primary barrier.

Flynn believes that there is no significant genetic difference in black/white (or any other populations) IQ. He is purely nurture. Murray (from the Bell Curve) believes it is both nature and nurture, and that it is probably more nature.
