Congrats Elena Kagan. Looks like his O ness did you a solid by getting you a lifetime appointment to the most powerful court in the land. Nice.
I could say so much about this pick, but I will leave it alone. (For now) Ms. Kagan certainly has all the right credentials: Princeton. Harvard. You can't get much better than that in the academic department. Still, the liberals are nervous about her. And the wingnuts, of course, believe that O picked her because she is a secret Socialist, just like him.
Some folks are already whining that she has no judicial experience, but then some of our best supremes never had judicial experience. So that's a none issue as far as I am concerned. Personally, it would have been nice if O had put a person of color on the court. (Hey, we could use one. Lord knows we don't have any now.) But, at the end of the day, it's O's call. Besides, the person's color, gender, or religious affiliation- or lack of it- isn't as important to me as how they are going to rule on the important issues of the day.
Of course the rethugs are already getting ready for a fight. It must have been tough for them. Kagan never wrote judicial opinions so there is no paper trail for them to go over to try and find any got ya notes in her writings.

Kagan quoted from a speech Marshall gave in 1987 in which he said the Constitution as originally conceived and drafted was "defective." She quoted him as saying the Supreme Court's mission was to "show a special solicitude for the despised and the disadvantaged."
The Sotomayor confirmation process, I think, firmly established how various factions feel about empathizing with the "despised and disadvantaged." Now, the RNC wants to know, "Does Kagan Still View Constitution 'As Originally Drafted And Conceived' As 'Defective'?......"

The recent omission of a diverse choice for the supreme court vacancy with the retirement of Justice Stevens by Obama is troubling on so many levels. Apparently unless you are white, jewish, christian and a graduate of an ivy league law school it is best not to apply for this job. Those who are still cheerleaders for Obama have a lot of explaining to do. Asian and Arab americans as well buddhists, moslems and atheists need not apply .

If the Constitution was perfect then it wouldn't need amendments. The framers understood this and understood that it would need to be a living document that would grow as the country grew.
ReplyDeleteThere were portions of the Constitution that were very clearly defective, slavery and a voting franchise limited to white men leap to mind. Acknowledging those facts does not diminish the Constitution. On the contrary, the fact that the document has been revised to correct the flaws is probably the greatest praise one can give to the Constitution.
Of course the constitution was defective and yes the amendments helped but some of them were defective i.e the 18th amendment..

(See Clarence Thomas) Sorry, that's just a reality. I am not down with symbolism that ends up hurting more than it helps. What if I told you that there were Af. American judges out here that we don't want to go before on certain types of cases because they are very pro police. On the other hand, there are white judges who, when I see their names on the list, I believe my client will get a fairer shake. That's the reality of practicing out here in the real world. It's nice to say that we have a Af. American Judges or Presidents or whatever, but at the end of the day, it's what happens in the real world that counts. It is your logic that is flawed, because you bash Obama yet advocate for more blacks in positions of power for symbolism sake. And it has nothing to do with qualifications, I am sure that conservatives believe that Clarence Thomas is very qualified.
But again, try placing your focus on a real Obama defender and ask them about the vetting process and why his choices were so limited to begin with. As is the case with your Windies friends, I can't help you with that one.

I don't care who she clerked for..she does not have the same experiences in life that are common amongst black women. Obama should have at least tried to push a competent black woman through (and they are out there).
It is past the time that a black woman should be holding a seat on the SC for the betterment of all people. A black woman would have brought her experiences to the Court just as Kagan will.
Obama's move was purely political as all appointments are (for the Court and off the Court)...
IMHO, Obama nominated her because the Senate will approve her without a lot of hoopla. Obama owes favors (as all politicians do) and this move can wipe his slate clean for the rest of his term.
However, if there was no balance before there is really no balance now. We may be seeing some rulings that come under a "group think" mentality once she dons the robe (and she will) since the Court will all be Harvard and Yale with one exception.
However, we have had worse and lived with it.

I have never seen a time in this country since the Nixon Administration where actual funds (not programs) were accessible for blacks and minority women.
Due to this administration I have been able to access more government money for my clients than I have in many years. You have to follow the money.

Apparently unless you are white, jewish, christian and a graduate of an ivy league law school it is best not to apply for this job. UTS, I think the difference between us and many on the blogging left is that we've lived the life of rising Black professionals -- ie 'the only one in our department', so we know how to pick and choose a battle. Many lefties don't live in the 'real world' of business and politics -- where deals have be made and you have to work with what you've got. Obama's got a giant oil spill in the Gulf, flooding in Nashville, a myriad of banking issues and stable but still a horrid economy. And the GOP old guard are terrified of the Tea Party loons taking over the nominating process.

Being a systems engineer and project manager, I've learned that not every fight is worth fighting. Clients will always be incompetent jerks who think they know computer systems better than guys with masters degrees in electrical engineering and networking certifications (especially if they have an MD, PhD or JD behind their names), bosses will always throw on more work than you think you can handle effectively and you'll always a have one or two pricks in the office. I learned the hard way to just let 70% of things slide -- its not worth my peace of mind.

WASHINGTON — The selection of Solicitor General Elena Kagan to be the nation’s 112th justice extends a quarter-century pattern in which Republican presidents generally install strong conservatives on the Supreme Court while Democratic presidents pick candidates who often disappoint their liberal base.
Ms. Kagan is certainly too liberal for conservatives, who quickly criticized her nomination on Monday as a radical threat. But much like every other Democratic nominee since the 1960s, she does not fit the profile sought by the left, which hungers for a full-throated counterweight to the court’s conservative leader, Justice Antonin Scalia.
In many ways, this reflects how much the nation’s long war over the judiciary has evolved since Ms. Kagan was a child. While the American left back then used the Supreme Court to promote social change in areas like religion, race and abortion, today it looks at it more as a backstop to defend those rulings. The right, on the other hand, remains aggrieved and has waged an energetic campaign to make the court an agent of change reversing some of those holdings.
Along the way, conservatives have largely succeeded in framing the debate, putting liberals on the defensive. Sonia Sotomayor echoed conservatives in her Supreme Court confirmation hearings last year by rejecting the idea of a “living” Constitution that evolves, and even President Obama recently said the court had gone too far in the past. While conservatives have played a powerful role in influencing Republican nominations, liberals have not been as potent in Democratic selections.
In that vein, then, no Democratic nominee since Thurgood Marshall in 1967 has been the sort of outspoken liberal champion that the left craves, while Justice Scalia has been joined by three other solid conservatives in Chief Justice John G. Roberts Jr. and Justices Clarence Thomas and Samuel A. Alito Jr. By all accounts, Mr. Obama did not even consider the candidates favored most by the left, like Harold Hongju Koh, his State Department legal adviser, or Pamela S. Karlan, a Stanford Law School professor.
“Why do the conservatives always get the conservatives, but we don’t get to get the liberals?” Senator Tom Harkin, Democrat of Iowa, asked the Web site Politico recently, voicing the frustration of the left when Ms. Kagan was considered a front-runner but was not yet Mr. Obama’s selection. “What the hell is that all about?”

I'm speaking of graduates with high GPA's.
They had to either settle for low paying jobs in North Carolina Call Centers or relocate to a different state.
This is still going on today.
What are North Carolina's Black "Leaders" doing about it?
NOTHING!
Because they are SCARED and ONLY care about themselves or friends.
Thus I don't care if another Black Attorney (no offense) or Judge is EVER nominated to sit in front of a Senate Judiciary Committee Confirmation Hearing.
Its better for a White, Hispanic or Asian Judge to rule effectively on my behalf, than a Black SCARED-A_ S Justice sitting on the bench for symbolic purposes.

Thirty one of the school’s 32 tenure-track hires were white, and none were African American or Hispanic. Apparently no “qualified” minorities could be found). She was named Solicitor General—that is, the federal government’s top courtroom lawyer—without ever having appeared in a courtroom on behalf of a client. Now someone who has never been a judge, and, far more important, has taken almost no public positions on any issue relevant to being a judge, is on the verge of being put on the Supreme Court.

Like Malcolm X, I nurtured high hopes and expectations for "our" people: I honestly believed and expected that "we" black people were "better than...crackers" - even the "crackers" who occupy the Senate and base of the repugnican party. A situation which was one of the components contributing to the current economic Depression.
So the "overtaxed" argument is bullshit.
Second - "waste". The principal governmental waste today is in the Military, and the perhaps $500 billion scammed as part of the "Iraq War". The Tea Baggers had their guy, the Bushit - in charge for 8 years, a conservative 5-4 majority in the SC, and a Republican dominated legislature for 6 of those 8 yeras. During that period the Untied States dropped from the 2nd least corrupt nation to the 13th. At this point arguing that health care is going to bankrupt and already bankrupt economy - when a mindless dedication to supporting the Bushit war on Iraq to feed the Defense Industry was a major contributor to the depression we are in in the first place...
Is outright asinine.
Third, I'm fully cognizant that the majority of the black Middle Class got there through blue collar jobs. The Tea Baggers are made up of upper middle class, modestly educated, white collar, white folks with a median age of 50. I just don't see any commonality. Worse, the demographics of the Tea Baggers in terms of age are only slightly better than the Republican Party. Roughly 60% of the black population in this country is under 30...
What do they have in common with old white men, who've already made their bullet?

ALL WITHOUT the Black Community doing sufficient INTROSPECTION as to how they have actually benefited from the PROGRESSIVE TAKE OVER that is presently among them.

The suburbs remain as segregated as the cities. Black middle and upper middle class areas are primarily Democratic.

In fact I heard Michael Baiseden say he was open to any Republican, particularly a black Republican, coming on his show and making the GOP case.

In the last 40 years the black middle class has tripled as have the number of black professionals, business owners and home owners.
The number of blacks in poverty diametrically reversed in that period from over 60% to 22%.
It is essential to your nefarious buckdancing mission to depict the black community en masse as dysfunctional ghetto dwellers but by now most people see through your game.
