Joe the hero!


"CALLER: He's going out the window right in and out of. I've got to go, buddy. I'm sorry but he's coming out the window. 911 Operator: Don't go out the door. Mr. Horn? CALLER: They just stole something. I'm going out the door. I ain't going to let them get away with this. They stole something. They got a bag of cash. I'm doing it. 911 Operator: Mr. Horn, do not go out of the house. CALLER: This ain't right, buddy. 911 Operator: You are going to go outside the house if you go out the house with a gun. Stay in the house. CALLER: They're getting away. 911 Operator: That's all right. Property's not worth killing someone over, okay? CALLER: Damn it. 911 Operator: Don't go out the house, don't be shooting nobody. I know you're frustrated but don't do it. CALLER: They got a bag of loot. 911 Operator: Okay. How big is the bag? They are carrying by hand -- they are walking out? Which way are they going? CALLER: I can't -- I'm going outside. I'll find out. 911 Operator: I don't want you going outside, Mr. Horn. CALLER: Well, here it goes, buddy. You hear the shotgun clicking and I'm going. 911 Operator: Don't go outside. CALLER: Don't move, you're dead. (Gunfire)"


That was the 911 transcript from my man Joe Horn's Clint Eastwood moment when he took the lives of two human beings by shooting them in the back. Now Joe is a fucking hero to some of his peeps in Houston (t)exas. "Joe may I have your autograph?"


I know I know, in (t)exas you can use deadly force to defend your neighbor's property. (Although I think the statute is meant for night time incidents only) But when I heard that tape I was convinced that old Joe was going to kill one of those "niggers" he saw burglarizing his neighbors home no matter what. Of course old Joe's attorney said he acted in self defense. Seems when old Joe ran out on his lawn shot gun in hand, one of the burglars turned towards him when he said, "don't move". Yep, that was his cue to let those brown mother fuckers have it. I think Joe felt his life was in danger.


Now I have been watching this case for awhile now, and I can't wait to see if the Harris County grand jury comes back with a criminal indictment against the "nigger" shooter. Hmmm, we are, after all, talking about (t)exas. In fact, I bet ole Joe is a hero to most of his neighbors. Hey, we just can't have these illegals running around breaking into people's homes now can we? "Don't mess with (t)exas." The wages of burglary is death! I even hear that a Houston plain clothes police officer who heard and was answering the 911 call, witnessed the shooting. His ass was lucky he wasn't black, or he would have been shot too. "Mr.. Horn put down that gun, I am a police officer. Yeah right nigger, bang!" But seriously, what the fuck is wrong with these people in (t)exas? Now there are dueling protest and the community has been torn along racial lines because of this bullshit. My question is why? The man shot two people who were robbing another person's house in broad daylight in the back!


Remember that old joke? Where the old southern law man comes upon the body of a black man hanging in a tree with a shotgun blast to the back of his head? And he spits out his chewing tobacco and says: "Damnm, worse case of suicide I done ever seen." That story reminds me of old Joe and his attorney when they say he acted in self defense. If you believe Joe that old Sheriff's assessment of seeing that black man in the tree wasn't so far fetched, and you probably didn't think that joke was funny. If you don't believe Joe, you are probably laughing your ass off.

    We've been sitting on this for a few weeks down here. But with the new information that came out on Friday, it is definitely clear that this is yet another case of summary justice American-style, much like the Taser craze that seems to be going around. Horn didn't know these dudes were Hispanic I'm willing to bet, simply thinking they were Black. I'm still waiting to hear something, anything on this from the Hispanic community. Bubba is out in full effect though.

    And for the record I don't think there's a snowball's chance in hell they charge ol' Joe with anything more than a misdemeanor, if that.

    I know, I know, today kids own the word, use it in conversation, use it in song lyrics, etc., and maybe I'm just too old to change with the times.

    He had the right to defend his own property, not his neighbors.

    He had already done what a good neighbor is supposed to do; call the po-po. The 911 operator kept telling him not to go over there and start shooting. If the operator had said, "Hell, gon' over there and blow their asses away" that operator would be unemployed now, and someone would be on the receiving end of a lawsuit.

    As it is, this guy's Jack Bauer moment should earn him a dime stretch up in Huntsville, where some dudes named Bubba, LeRoy, Biscuit and Skillet will get in line to make him a prison bitch.

    Even in Texas, justice can occasionally be served; just not for Black and Brown people.

    The sad thing is, the brown people can't bring a lawsuit because they might be here illegally and that would be a sure route to deportation...

    Then I read that the crime wasn't even in his own house and that it was broad daylight. This guy is a criminal who wanted to blast somebody. It was only a matter of time before he did.
    I would like some more information before I decide whether or not it's a racilly motivated killing.

    I have no problem with shooting people breaking into someones home while they are home but this was uncalled for.

    Burglary hasn't been an capital offence for at least 150yrs so clearly when it happens in the daylight to a empty home does not pose such a danger that people need to lose their lives.

    The idiot should have just let the cops come and do their job LOL now his life is in danger

    In Texas this is completely legal. I lived in Sugar Land,about 20 miles from Houston, for one year (work purposes). Obviously,my local news feed came from Houston so, I heard about many cases like this. I learned a few things living in Texas:

    1) You can kill protecting your property or that of your neighbor. If a criminal is trying to leave your property after discovering you are home, people willing give tips on how to drag the person into your home and shoot them anyway. I kid you not.

    2) You can kill your wife if you catch her with another man. It is generally called a "heat of passion" crime and the man is slapped on the wrist for it. Yes, there is a law stating it is acceptable to kill your wife "in the heat of the moment".

    3) If you are a woman (think Clara Harris) you cannot, under any circumstances use the "heat of passion" defense. It will back fire, you become the "black widow" and your ass ends up going to jail, no matter how accomplished you are.

    4) If you are uber wealthy (think Dupont wealthy), you may get by with killing your neighbor FOR NO REASON (I watched a Dupont heir get acquitted for doing just that)and there is no double jeopardy so, you cannot go on trial again.

    5) If you are a crazy prozac taking, Christian white bitch (think Andrea Yates), you can kill all 5 of your kids and end up in a mental institution with the possibility of getting out in 15-20 years if some judge choose to let you out.

    6) You cannot under any circumstances kill a white person, if you are of the negro persuasion. If you do, look for automatic death penalty. No questions asked.

    7) A white person can kill anyone he so chooses. No matter race nor gender. See James Byrd. The D.A. wasn't originally going to ask for death in that case because no white man in Texas history, had ever been put on death row for killing a black person. The reverse happens all the time, though. Look up death row in Texas and you will see nothing but negroes on the row for killing "Mr. Charlie" or "Missy Anne".

    All I'm saying is this case is no different from any other bullshit that happens in the Republic of Tex-ASS. Don't be surprised when he gets off....and he will get off.

  21. I'm from Houston originally and I can tell you that many Houstonians who are Black, White or Hispanic may not agree with Joe actions, but they also have a low tolerance for criminals so they will have little sympathy for the burglarers.

    Texas has conceal and carry laws and you better know that Whites are not the only ones packing: I have many relatives and friends that own guns and have the "shoot first ask questions later" mentality. Texas is overall a conservative state, but you will find that Blacks and Whites share similar values when it comes to their property.

    Let me also point out that I believe Quanell X is a race mongerer and fraud. Any incident that involves a Non-white and a White, you can bet your last dollar Mr. X will drive up in his white Range Rover wearing his thousand dollar suits to get his mug either on KTRK or in the Chron. I'm really tired of this guy.

    Lastly FN here's what the Texas Penal Code Title 2, Chapter 9, Section 43 says about the matter. I'd be interested in your legal interpretation based on the what you know thus far.

    § 9.43. PROTECTION OF THIRD PERSON'S PROPERTY. A person
    is justified in using force or deadly force against another to
    protect land or tangible, movable property of a third person if,
    under the circumstances as he reasonably believes them to be, the
    actor would be justified under Section 9.41 or 9.42 in using force
    or deadly force to protect his own land or property and:

    (1) the actor reasonably believes the unlawful
    interference constitutes attempted or consummated theft of or
    criminal mischief to the tangible, movable property; or

    (2) the actor reasonably believes that:

    (A) the third person has requested his protection
    of the land or property;

    (B) he has a legal duty to protect the third
    person's land or property; or

    (C) the third person whose land or property he
    uses force or deadly force to protect is the actor's spouse, parent,
    or child, resides with the actor, or is under the actor's care.

    Way back before the turn of the century, when I became a firearms owner (and something of an enthusiast) I took the NRA Personal Protection class.

    Now, this was here in O-hi-O, and so the laws in particular may be different.

    BUT-- in my class of about 8, there was an attractive young white woman, a middle-aged semi-frumpy white woman, several white guys and me.

    In the lecture on the law and the Rules of Engagement, the instructor (an attorney, BTW) pointed out a little factoid that everyone knows but too many hate to admit.

    "If you use a firearm, even in self defense, you may expect to be interviewed by the police. You," he said, pointing at the attractive young white girl, "can almost certainly get away with it. You," he said, pointing at the middle-aged white woman, "will probably get away with it. YOU, on the other hand," pointing at me, the dark face in the room, "are gonna go to jail."

    "Tell me something I don't know," I replied.

    After the titters died down, the instructor took pains to say that he intended no offense, but "you know, that's just the way it is."

    Under the ROE I was taught, Redneck Joe would be-- or at least, should be under indictment for murder.

    This being A-Merry-Ca, I think we can all agree that won't happen.

  26. Years ago I was leaving a bar one night and this absolutely smoking hot girl leaned drunkenly into my window and asked me for a ride home. As we were driving she seductively leaned over and started licking my ear. I continued to drive, enjoying the attention when suddenly, ear drum shattering snoring broke my concentration. I pulled over and pushed the girl back onto the passenger seat. Upon doing so her skirt came up a bit so I could see her lacy undies. Immediately I thought about the scene in "Animal House" where the Angel pops up on one shoulder and the Devil on the other. I sat staring at her beautiful body, contemplating my next move. I reached into her purse, found her licsense and drove her to the address on the licsense. I dragged her up the stairs of the home and was greeted at the door by her boyfriend who was pissed. I explained the situation minus the ear licking and the carnal thoughts I had while gazing at her unconsious frame draped across my front seat. He begrudgingly thanked me for helping and I split as fast as I could.

    The point of the story: I could have taken advantage of a situation to live out a fantasy , but at what cost?

    Joe seized the day and got to live out his fantasy. Unfortunately we know the cost of his fantasy.

    I was born in Texas and lived in Houston until my parents split (age 12).

    My dad started a business, helped set up by his cousin. He didn't wait for the business license to open shop. One night, a man tried to rob the joint and came at my father with a knife.

    My dad shot him in self-defense. He was charged by the state of Texas with second-degree murder. When he went on trial, the jury was allowed to consider the lesser charge of involuntary manslaughter.

    20 witnesses in the establishment confirmed that my father shot the would be assailant in self-defense.

    Think he got off? Hell, no; the jury came back with a verdict of guilty of the crime of involuntary manslaughter. Daddy did eighteen months in Hunstville.

    Meanwhile, his business went belly up, my mom had had enough, Daddy became an abusive alcoholic and we wound up moving to California.

    Why did I share that?

    To illustrate just how the justice system in Texas runs and operates. You get justice if you're a white male. You don't get justice if you're one of the following:

    Female of any race (see Clara Harris)
    African-American (gender not an issue)
    Latino
    Asian
    Native American
    Member of the LGBT community.

    Now all of us who have been to law school, and those of us who haven't seen the inside of law school, all know that Joe Horn should do some time for shooting those robbers because it was pre-meditated.

    When he was on the phone to 911, he had time to cool off and think about what he was going to do. The fact that he told the 911 operator what he was fixin' to do indicates pre-meditation (no heat of passion or self-defense). Self-defense flies if they were breaking into his house not his neighbors.

    But because this is the Lone Star state, where "Bubba" rules, this guy's going to walk, instead of being sent to Huntsville for that dime stretch and becoming a prison bitch who would find Jesus after two or three years of being locked up.

    I tell you, I have to laugh to keep from screaming or crying up in this here...and everyone of you who said this about Texas - the best thing you can say about Texas is how all of your exes live there.

    In Texas, if you have your business license, you can shoot anyone who tries to harm or rob you. Show that business license and you get to walk.

    My father didn't have his business license, and that's why his offense was treated as a major crime by the state of Texas.

    Texas (next to Alabama, Mississippi and Louisiana) is the only state probably still fighting the civil war, and has been stuck there ever since.

  31. His actions certainly sound premeditated to me. I am not familiar with the TX jurisdiction but as far as I know, you can't shoot at someone like he did unless there was reason to believe they posed a threat to him. Again, TX is fucked up however.

    CPL-Your dad should have gotten off or not even seen the inside of a court since he was responding to deadly force with the same. Unless he caused the need for deadly self defense he should have been afforded that defense himself. Again, regarding TX-see above.

    How is someone going to witness the shooting (presuming you're talking about in person) if they're on the phone, and all they heard was "Move, You're Dead" and two gunshots?

    Regardless, I do admire that he came to the defense of his neighbor's home BUT killing them, especially with shots to the back, was a bit much to say the least. I somehow doubt they were running away still carrying whatever they stole.

    Texas law is so, so backwards and confusing, and I read up on the laws, and he will get off because technically he was within the bounds of state law.

    We Texans love our guns, but the state does not give us carte blanche to use them either. You can only shoot someone when your life is in danger. Even with a break in, until the person is inside your home, you cannot legally use deadly force.


    I find it hard to believe he won't do some time for this (White man or not) More than likely he will
    plea out to a lesser charge (manslaughter, which is a 2nd degree felony here) and serve about 60% of his sentence.

    But if you read the statutes, be definition, he committed murder. I can't wait to see this play out

    I was going to blog about this. You beat me to it. When I first heard about this, I thought that the dude shot those men as they were breaking into HIS house. If that were the case, then the guy was justified. But his neighbor's house? Give me a fucking break!! He did right by calling the fuzz, but that was murder pure and simple. I know that here in Texas, you can shoot a person if you feel threatened. Like say for instance.... You are at stoplight and an homeless person comes up to your car window. You have the right to shoot that person if you feel like he/she was endangering your life or your property. There was a guy a couple of weeks ago here in Dallas that shot and killed 2 people in 3 days because he felt threatened. No charges were filed. Only in Texas!! When you cross the border into Texas, the first sign you see is "Don't mess with Texas". They literally mean that shit out here!!!

  36. redlistick, I think they call that the "Castle Doctrine" in (t)exas, and it seems to go contrary to the common law doctrine of not using deadly force to protect ones property. They basically extend the right to protect individual property to your neighbors. They have extended self defense to actual property. Interesting.

    Still, I heard Horn's attorney claim that he is not even invoking the "Castle Doctrine" he is using good old self defense. I really want to see that one fly if he is charged.

    As far as the Texas case, I do not agree with people acting as judge/jury/exeutior. That is obviously dangerous.

    I think they are only filing charges and turning it over to the grand jury due to social pressure from blacks and Hispanics.

    Remember these were illegal black Latinos. Houston is about 60% black+Latino, Houston being in Harris County. Pasadena is about 50% Hispanic.

    "A person is justified in using deadly force against another to pervent the other who is fleeing after committing burglary, robbery, or theft during the nighttime, from escaping with the property and he reasonable believes that the property cannot be recovered by any other means; or, the use of force other than deadly force to protect or recover the property would expose him or another to a substantial risk of death or serious bodily injury. (Nighttime is defined as the period 30 minutes after sunset until 30 minutes before sunrise.)"


    Protection of the Property of Others

    "A person is justified in using force or deadly force against another to protect the property of a third person if he reasonably believes he would be justified to use similar force to protect his own property, and he reasonably believes that there existed an attempt or actual commission of the crime of theft or criminal mischief."

    "Also, a person is justified in using force or deadly force if he reasonably believes that the third person has requested his protection of property; or he has a legal duty to protect the property; or the third person whose property he is protecting is his spouse, parent or child."

    The State of Texas has given any man the right to shoot someone dead if they think that man is involved in hurting someone or stealing from them.

    It does not seem to matter if it is premeditated, and it does NOT have to be self defense.

    If the person is doing it, you can use deadly force.

    The only question is "reasonable".

    I'm almost certain, after living in Texas, most people in Harris County (white and otherwise) will find it reasonable.

    Guess Texas should just disband the police force.

    In Canada you'd be in a world of trouble. Even if the criminal is in your house shooting him will result in your doing some real time in prison. No matter what colour your skin is, or the colour of the criminals skin, your heading to jail. Another slight difference in Canada is that prisons at the moment are not a growth industry here as far as I know.

    I think the Texan was most likely as many here said looking for an excuse to use his gun. Not to say I have any real sympathy for the criminals, but this was a matter easily handle by the police that were surely on their way.

    As the old saying goes...don't do the crime if you can't do the time.

No matter what colour your skin is, or the colour of the criminals skin, your heading to jail. Another slight difference in Canada is that prisons at the moment are not a growth industry here as far as I know.

    I think the Texan was most likely as many here said looking for an excuse to use his gun. Not to say I have any real sympathy for the criminals, but this was a matter easily handle by the police that were surely on their way.

    As the old saying goes...don't do the crime if you can't do the time.

    White, 53, is charged with second-degree manslaughter and weapons possession in the Aug. 9, 2006, killing, in which prosecutors say White fatally shot Cicciaro, 17.

    I'll keep this simple- you know why people going to stores and buying things didn't have to worry about Joe shooting them? Because they were BUYING things- not stealing them.

    When these two inidividuals set out to commit a burglary, they should have taken in mind that they were in the wrong at that point. They were killed as a consequence of doing something wrong and there's no way around it. Had they been walking through this neighborhood minding their business, would they have been shot?     yes, they were wrong that is not the question. The question is if this guy went out there to kill or to stop them or stop them by killing them. To me it seems like he went out there with the intention to kill them. I'm not coming from a place of race. My opinion stops at the place when he says I'm gon kill em... to me that says he's not try'n to hear nothing or even give them a chance.
    It's like this man... we either gon allow the law to be the law or we're gon be the law we can't have it both ways.

  49. Here we go with the Texas bashing. When last I checked a certain city up north had private citizens taking to the streets because of a slew of murders of young black men. But anyway, the Joe story is a big one down here. The Houston Chronicle is obsessed with this case and there is an interview of Joe in today's issue.

    Another angle in all of this is that the two that were killed were illegal immigrants and that's a whole other can of worms so essentially you have a convergence of the gun rights folks, the suburban property owners, the general law and order Texan (Black , White and Hispanic), and yes, the garden variety racists.

    Not helping things is the emergence of “community leader” Quanell X. Quanell's involvement alone is cause for the grand jury to let ole' Joe walk. If they manage to get past the grand jury stage, I can't see a jury in Harris County convicting him. In fact there have been a spate of recent shootings where property owners are shooting buglers and robbers. So there is a ripple “Joe” phenomenon.

    Yes, in Texas, you can use deadly force to protect property. For those wanting to do a legal analysis, here is the chapter out of the Penal Code. I believe this has the revision from the latest legislative session http://www.texaspolicecentral.com/2007_-_2008_Penal_Code.pdf. Chapter 9 deals with defense of self and property and the property of others. My interpretation of the statute related to the defense of a neighbor's property is that he would have an EXTREMLY strong leg to stand on IF THIS HAD HAPPENED AT NIGHT (it happened in broad daylight), especially with a sympathetic jury pool. It will be interesting to hear the testimony of the off duty police officer who responded to the call and had to duck because he feared Joe would shoot him too.
