My man Cal Soldier actually commented on this next topic and made me decide to blog about it tonight. I am talking, of course, about the upcoming trial of alleged 911 mastermind Khalid Shaikh Mohammed. Yes it seems that his O ness has decided to put my man on trial just blocks from where he allegedly slaughtered over two thousand people. Folks, if you think the O.J. trial was a circus, just wait until this one gets going.
I can't say I blame his O ness. This is, after all, a country of laws. At least the last time I checked it was. The folks over at Radio Rwanda and on the right are proclaiming that this is a civil trial, -as if we were suing the guy for money or something- but it's actually a civil-ian trial. Which means it will not be in secret or in a military court. But it's funny how some people play with words. "Civil" trial sounds so much softer.
But field, think of all the security that will be needed to try this guy, why even go through with all of this? Yes, you are right, maybe we should have just taken him out and shot him like Glen Beck recently suggested on his radio program. I guess that's the right wing way of doing things. It worked pretty well for them back in the day when those "strange fruits" were hanging from trees. Or, maybe we could just stone him to death like they would do in some of those countries where his Muslim brothers reside.
Over at Radio Rwanda they are terrified that Mohammed could actually be found innocent. And, that somehow the trial won't get the correct result that we are all seeking. (??????) Wait, it's a trial, which means that if there is a possibility that he is innocent he should be found not guilty. I mean that is how A-merry-can jurisprudence works, right?
But field, why should this guy be treated like any other ordinary criminal? He is a terrorist. We don't need a show trial to fire up the terrorist. This guy wants to die.
Because he is an alleged criminal and a murderer, and, if convicted, he will be put to death. Besides, if he wants to die [as some are suggesting] maybe he will confess to the whole thing and save us all the trouble of a trial.
"Mr. Holder said he would instruct prosecutors to seek death sentences for Mr. Mohammed and four accused Sept. 11 co-conspirators who would be tried alongside him."
Yep, I would say that if found guilty he would suffer the same fate he would if he was tried in a military court and found guilty. Unless, of course, the military has some other way of administering the death penalty that would make him even more dead.

So says republican Peter King of new York. And how exactly, Mr. King, is having a trial in new York going to do that? You mean as opposed to invading a country [that had nada to do with 911] and killing a bunch of Muslim women and children? Look, I know that my republican friends lost interest in verisimilitude a long time ago, but Mr. King, that is one hell of a reach.
Still, I get it, it's politics as usual. We always have to score cheap political points at any cost. Even at the expense of one of the tenets on which this country was built: The rule of law.

I am that the Justice Department made a decision to put the person on trial. I have a problem with the politicization when it should been a criminal case from the beginning. We can brand them as terrorists, but using the term is vague and intangible. Politicians have waged war on an intangible ideology that make a couple feel good, but symbolic at best. If we follow the logic of terrorists being tried in miltiary court, then Timothy McVigh should been tried under the same theory.

I've got two points of view here. When it comes to Mohammed and his ilk, I want them tried in open court. This country's strength comes from the rule of law, and our dedication to it - especially when the criminals commit disgusting and horrendous acts. This is what make us different than "pick a dictatorship" country that can accuse, try, and execute without fear of consequence.
We, as a country, are much better than that.
Now, for the USS Cole perpetrators - I really don't have an issue with them facing a military tribunal. The victims were military and the crime took place in a military-controlled area (a ship). Being a Soldier with extensive experience following and enforcing UCMJ, I trust the system in place.
Now, if this tribunal turns out to be the made-up thing that Mr. Bush and his cohorts created, then that's another story.
Bottom line is that we can't let fear keep us from applying the rule of law. That should be the #1 lesson from the Bush years.

The Administration is not trying everyone in civilian court. Some of the detainees will still be tried in front of military commissions-for example the guy who is a suspect in the bombing of the USS Cole.

When I was a private, decades ago, mys self and some other "trainee duds" were set to cleaning floors in a building where courts martial were being held. God-like individuals would walk over our work, and some would stop, survey our efforts, scream at us for our inadequecies as janitors, and leave more black streaks and "swirls" for us to clean up.
But it was the proceedings: one person would be sent into the board, would come out, and a major would stick out his head and bawl, "Bring in the next guilty turd"! (the posted results indicated that all brought before that board were, indeed, all 'guilty turds' we looked)
This same major gave us our UCMJ training, told us all about how it was even fairer than the civil system, presumtion of innocence...yeah.
Nope, never trusted the UCMJ and it's handlers, really.

I'm a veteran also. Pre- During- and Post- 9/11. I am very pleased that we are having a civilian trial. Courts martial for Hasan and the Cole attackers. Trial for 9/11.

A lot of black folks would settle for nothing but a conviction regardless of the facts. It doesn't matter if they shot that guy 50 times- HE WAS DRAGGING SOMEONE ALONG THE ROAD. And that someone happened to be a cop. You can't say with a straight face that black folks don't also demand verdicts to go their way under threats. A few dozen times prominent African American's have warned of another "LA Riot" if a jury did not come to the conclusion they wanted in cases.

As for people that think this guy could be found not guilty... that's a little hard when he has repeated over and over that he is. A trial is going to be more about the sentencing phase than innocence or guilt... and this guy WANTS to be put to death. Seems to me that having to serve out a life sentence in a maximum security prison is far more punishment than a swift death would ever be.. and it would deprive him of being a martyr.

ReplyDeleteThere is no disagreement, this is the legal system we have. If you commit a crime and are accused of such crime, then we have the legal system and process to trial this case. This person should had a trial more six years ago. The longer the case linger more difficult it is to trial as witnesses' memories fad. There times when have to set aside your emotions. This is not about politics, but allowing the legal sysem we have to work.

They (the authors) were reporters who did the job of investigating, writing and got Tim McVeigh's signature giving them permission for essentially writing McVeigh's biography. I see no grand conspiracy regarding the arrest, investigation and conviction of McVeigh. By the way, I visited your website and enjoyed reading The Highwayman poem today, that too is one of my favorites.

Jody - I am not a lawyer. Never professed to be one. Never told you that I DESIRED to be one.
As I watch the antics of some lawyers - I am happy that I have chosen the professional career path that I am on.
The ACLU was heavily involved with the Gitmo and Abu Gharab situation. THEY are responsible for undercutting the attempts of the Federal Government to detain people and keep them off of the battle field DURING A TIME OF WAR without having them set foot on American soil. What better place to have a prison camp than in the prison camp nation of Cuba - despite their free health care and $27 per month wages?

I believe that the VICTIMS of the CRIMINALS before they became VICTIMS of the criminal assault DESERVED the due process that the CRIMINAL did not choose to extend to this person.
It would be grand to see you TEACH LAW to Street Pirates Jody. Tell them about all of the CIVIL RIGHTS that they are violating. Tell the about all of the LAWS that they are violating. Tell them that our nation is built upon DUE PROCESS Jody.

ReplyDeleteOne should always first question the reaction within its historical tenet to see if it is justify. i can think of a whole lot of peoples and races who would in hindsight if they knew their histories well and were passionate about correcting the injustices may have been poised to do something in a similar vein..
was harriet tubman a terrorist or a freedom fighter...whose definition and whose lives... are some more valued than others? why is Libermann, et al. painting a Palestian kid who clearly states he does not wish to go fight and kill his Muslim brothers as a terrorist because he loses and kills 12 or 13 but sending drones into Afghan or Pakistani wedding parties and rocketing to death tens to hundreds..is not media hyped as terrorist? you let your nations military go and invade soveign nations and murder their leadership under the guise of "freedom" but havent even achieve that with your own citizenry... whose definition and whose lives? and how much value is yours versus another being...

It is amusing to hear Peter King of New York comment on terrorism. Consider his long time support for the IRA, one of the Western world's most vicious terrorist organisations that killed civilians (including women and children) over decades in the UK and further afield.

The problem is that, for some Americans in search of a cause (preferrably far away from home), any atrocities committed on non-Americans can be justified in terms of 'fighting for freedom' or what have you, whereas any reflection at all on why Americans may become targets is simply seen as pandering to terrorists.
All terrorism is wrong, including the kind that politicians like King have supported. I wonder what chance anyone having supported a Muslim terrorist group would have of becoming elected to the US Congress?
What about the terrorists that allow foreign countries to pay US representatives? What about the coup d'etat on the US treasury and the subsequent taxes that Americans black and white will have to bear. It looks like they got the wrong terrorist.

ReplyDeleteEveryone misses the point here...KSM is guilty, and will be found guilty...he'll probably demand to testify and admit guilt in open court. His alleged torture did not lead to any evidence against him, and would be suppressed in any event , but is of no consequence. As you doubtless know, the toughest judges and best prosecutors in this Country are in the S.D.N.Y. Neither Barry nor Holder are stupid...they know he'll fry... that's why they're making this such a showcase. Watch: it's the guys from GITMO they don't have much evidence against (@10-15 of 'em) that they will try & fry in private Military tribunals. The high profilers such as KSM will all be put on public display.Just watch...
Usually FN I'm down with what you have to say, but agreeing with the powers that be, by saying that KSM shouldn't be tried in Federal court is about as House as it gets.
