There is a government shutdown, but the Big R is still at it.

"After 40 years in solitary confinement, the terminally ill inmate may be going home.

U.S. District Judge Brian A. Jackson did a remarkably good and decent thing today -- something that every judge should aspire to do in the right circumstances. He found a way to bring a small measure of justice to a man whose entire life had been rife with injustice. He found a way to order the immediate release of Herman Wallace, a terminally ill prisoner who spent 40 years in solitary confinement at the notorious Angola prison in Louisiana in a 6' by 9' cell for a murder there was no valid evidence he committed.

Last week, I wrote about this case
here at The Atlantic because I felt it comprised so many of the failings of the American justice system. A black man whose trial is marked by racial animus. A defendant whose attorney does unconscionable work. A lack of physical evidence or adequate investigation. Co-defendants and state witnesses with obvious incentives to lie. Punishment that was both cruel and unusual. Deliberate indifference on the part of reviewing courts. It all happened to Herman Wallace. All of it and more; his case was a disgrace from the beginning.
Here is the link to Judge Jackson's order. If you read it, you will discover that he did not focus upon any of these constitutional infirmities in granting Wallace the relief he sought. Instead, Judge Jackson held that the original indictment against Wallace, over 40 years ago, was constitutionally flawed because women were excluded from his grand jury. So you can add "equal protection violation" to the heap of ways in which Wallace's rights were denied by our courts for four decades. Here is what the judge wrote:
The record in this case makes clear that Mr. Wallace's grand jury was improperly chosen in violation of the Fourteenth Amendment's guarantee of "the equal protection of the laws," and that the Louisiana courts, when presented with the opportunity to correct this error, failed to do so.... Our Constitution requires this result even where, as here, it means overturning Mr. Wallace's conviction nearly forty years after it was entered.
In the hours after the ruling was made public, state lawyers rushed to object to the judge's ruling, arguing that Wallace, who is dying of liver cancer and may have only days to live, did not deserve to be allowed to be freed on bail while Louisiana decides whether to retry him or not. The conduct of these officials on this day is nothing if not consistent with Louisiana's treatment of this man throughout his entire adult life -- cruel and unusual to the bitter end.

At long last, Herman Wallace should be allowed to die in peace, and in freedom, as far away from that dreaded prison as his breath will take him. Let his miserable life and his early death become a symbol for all that is wrong about what America accepts today in its justice systems. Let it be a lesson, too, about perseverance and the ceaseless value of redemption. For decades, while he sat alone in that tiny, fetid cell, justice delayed to Wallace was justice denied to him. But today, while he is still alive to savor it,  the law has turned away from injustice.

It is the first day of the rest of Herman Wallace's life -- and I sure hope it is not too late for him to enjoy it.

UPDATE: Immediately after Judge Jackson's initial order, attorneys with the East Baton Rouge district attorney's office filed a request to halt Wallace's release. This evening, Judge Jackson promptly rejected the request, again ordered the prisoner's immediate release, and warned prosecutors that they would be held in contempt if they refused to allow him to leave prison. Hi fives all around for Judge Jackson. Not so much for authorities in the state of Louisiana.

I bet that "celebrity couple" who got a dose of reality from "post racial" America
down in South Carolina are glad they didn't end up like Herman Wallace.

"Actors Cherie Johnson and Dennis White are speaking out about the way they were treated by a Marion County sheriff’s deputy when they were stopped on their way to Myrtle Beach. Johnson, best known for her roles in the television shows “Punky Brewster” and “Family Matters,” and her boyfriend, White, who was in the movie “Notorious,” said they were initially stopped and ticketed for speeding. A short time later, they pulled over to take pictures on the side of the road when they say another police officer pulled up behind their parked car.
'Cherie, she was like, ‘I’m just taking a picture,’ and put her hands up, and he grabbed for his gun and said, ‘Get in the car,'’’ White told TODAY’s Maria Schiavocampo on Wednesday.

'At that point, I was kind of like, ‘Whoa,’’’ Johnson told Schiavocampo.
The officer questioned them, asking them to step out of the car, and then initially claimed there was a warrant out for Johnson’s arrest, according to the couple.

'I said, ‘Sir are you doing this because we're black?’’’ Johnson said. 'He kind of just patted the car, gave me a look, and walked to his car. The next thing I knew, he was putting on his gloves, and he was handcuffing Dennis. I couldn’t understand why he was handcuffing. We didn’t do anything wrong.'

The couple claim the officer then accused them of having drugs in the car.
'I said, ‘Well, what was your probable cause?’ Johnson said. 'Why do you feel that you need to search the car?' He told me there could be a dead body in the trunk. That was the only probable cause he gave.'
 
The officer let them go after searching the car and finding nothing, and also later said there was no warrant out for Johnson’s arrest, according to the couple. The Marion County sheriff’s office released a statement saying racial profiling is “strictly prohibited” and that it “will take immediate and appropriate action” to investigate the allegations. It also is asking the state law enforcement division to review the allegations.

'I was praying,' Johnson told TODAY. 'I just wanted to call my mom. I was scared for our lives.'

'I just felt like there was nothing that we could’ve done to prevent that situation,' White added. " [Source]

Dennis, you could have stayed out of  South Carolina.

Finally, a conservative writer, Evan Gahr, (yes, I know some) reached out to me, because he knows how much I love to chase the Big R.

The irony is that he has a story of the Big R acting up and he cannot get FOX News or the Washington Post to report about it.

Here is the story in a nutshell:

"Father Lawrence Lucas, a controversial black priest, says that Kevin Merida, the first black managing editor of the Washington Post,  is a "house boy" for the power structure and "slave to money" because he refuses to report that his own paper is being sued for race discrimination by a longtime black  advertisement department employee who was fired by his white boss just days after she shrieked at him for no apparent reason. 
 
The lawsuit was first reported by Washington Gadfly Evan Gahr. 
 
In an interview, Lucas,  longtime pastor of a Harlem church,  made the same comments about New York Times managing editor Dean Baquet, the second black man to hold that post at the no longer paper of record.  Baquet has known about the story for almost three weeks.
 
"I’ll be damned. It’s awful," Lucas says. "Not every black face have the black community at heart rather than where the money’s are coming from. They’re slaves to the money and they don’t want to get the money baggers upset. These guys are not going to stick their not out. They are only thinking a bout their necks. It’s like expecting one cop to tell the truth about the other one."
  
Lucas said that the "money baggers" are advertisers who might be offended if the paper does the story. "
 
And this is what he wrote me:
 
"I sent the my story about the Washington Post being sued for race discrimination to O'Reilly's senior producer and two producers for Hannity. Given how both Hannity and O'Reilly love to humiliate the Washington Post I thought they would jump on it.

But neither used it.
Like I told you on the phone, conservatives refuse to do this story because they don't want to admit there is still race discrimination in this country. Liberals won't touch it because they don't want to embarrass their friends at the Washington Post."
 
I actually agree with him.

    Honestly Field if it says that he may have only days to live, and it's liver cancer, he may already be in a coma! I hope he does live to enjoy some of his freedom. To think that they can actually place a person in solitary confinement for 40 years! I thought that was no longer done? OMG!

    Poor Ms.Johnson and Mr.White. It sounds like a horrible experience and a feeling of total helplessness in the face of injustice!

    Have to agree with you about SC, that and Maine are the only states I have never been. I may hit Maine one day but SC may be the only state the X man may never set foot in. Hell, I'm in Kansas now and I'm sure this is 1000% better than SC.

    What I find fascinating about Blacks is they are always sad, but never angry about the injustices perpetrated on them. It makes you wonder about the range of their feelings.

    Even Black Sage, wants to move on from the saga of racism to the 'next' story. Amazing! Very few people of color are 'angry' enough, to raise hell about an egregious system of injustice against them.

    There are two obvious reasons for this attitude of 'sadness': "suppressed anger" and "profound depression", which leads to a life of 'sadness'--whether embraced or denied.

    Powerlessness. Helplessness. That is the problem for Blacks--of which any Black will deny. It's a vicious psychosis that perpetuates cyclical neurosis. And that gets back to what Desert said, "it's sad, sad, sad....Everything is sad, now." Yes, indeed. Everything IS sad....for Blacks.

    If you are Black, and I assume most are on FN, you have GOT to know that Herman Wallace isn't the only case of injustice in Louisiana. There are plenty but it's accepted by so many Blacks and Whites that no one cares anymore...or maybe they never cared?

    What’s at stake in the partial “shutdown” of government? Certainly not Obamacare, which was never in danger. It’s all an exercise in drawing fake lines in the sandbox, so that the bipartisan business of gutting entitlement programs can recommence. Next stop: Grand Bargain junction

    The government shutdown battle is more like a Civil War reenactment than the real thing. A face-saving bargain will soon be struck, returning 825,000 furloughed federal employees to their jobs at wages that have been frozen for the past two years – not by the Republicans, but on President Obama’s orders. The clock has been stuck with both hands on “austerity” since Obama came fully out of the closet as a GOP fellow-traveler following the 2010 midterm elections. True to form conservatives are up in arms about shutting down monuments to war but when it comes to kids with cancer being harmed crickets. And if you two are so out of touch you weren't aware of the REpublican attempt at grandstanding and heard it first from me here I don't know what to tell you. Also, I would have had a bigger problem if the prez gave up on health care for millions just to keep museums open. SMDH.

    This is one single employee suing because he claims to have been treated badly by one other employee. Even if it's true (which it might not be -- no judgment has yet been rendered), this is still not an indication of any kind of systemic discrimination at the Washington Post.

    I fail to see how this is significant enough to be newsworthy in the first place, so failing to report on it is hardly some indication of a shameful cover-up by the Post's editor.

    What I find fascinating about Blacks is they are always sad, but never angry about the injustices perpetrated on them. It makes you wonder about the range of their feelings.
    Even Black Sage, wants to move on from the saga of racism to the 'next' story. Amazing! Very few people of color are 'angry' enough, to raise hell about an egregious system of injustice against them.

  40. Bill, this is a common sentiment among conservatives that unions are bad and hurt workers. As a union member I can tell you conclusively this is untrue. You call unions greedy are corporations and/or upper management greedy for wanting to maximize profits/benefits and wages? Amazing this is always so one sided, workers are greedy for trying to get fair wages and benefits and oh the poor poor management who have to deal with lazy greedy workers. No mention of how public sector unions fight to keep their members safe and protected. Ask a firefighter if their unions had to fight to get safety equipment to make their jobs safer. Ask a cop if they've had to use a union lawyer to fight a charge and if they could afford such a good attorney on their own. I won't even get into how much safer US air travel is now due to the efforts of pilots' unions. If we take a simplistic superficial view we can say unions bad but if we were to take a more nuanced look we can find benefit to union membership for workers and the pubic at large. Then again most conservatives tend to take a simplistic linear thought process most of the time. Funny, they tell me how bad unions are but as far as pilots go we all choose to join and keep them. Trust me Bill, if you were a pilot for a major US airline your opinion of unions would be a lot different especially if you imagine the working conditions you'd be exposed to if management had its druthers. Bottom line they aren't the bogey man conservatives make them out to be.

    Let me begin by saying at one time unions were needed, the time has passed.

    I see a big difference between a Google union and a government employee union.
    I feel safe in saying that not one google employee paid union dues and those dues got turned over (bribe, payoff, political contribution, whatever method) to the owners of google.

    Lazy greedy workers – of course not all. As time goes by it is getting worse. Getting worse not because of unions, getting worse because society is getting worse.

    Unions not needed anymore- The simple answer is when unions were started there were no lawyer ads on teev like there are now. In 2012, who doesn’t know how to raise a stink about working conditions. A couple years back was it Schwarzenegger’s non-union housekeeper getting a lot of press. True, he’s famous but it points out that people are savvy enough to know how to get their just rewards from the situation. Even people quitting their jobs are savvy enough to make a viral dancing video. The average Joe Worker years ago never had the opportunity to make his problems known not only across the county but the world.

    Without a doubt Unions got things turned around and headed in a better direction.

    Air Pilot unions- I’m assuming non-government, I’ve got no problem with it. Glad it’s working for you and the airline. If you weren’t union, could you still work for the airline?
    You say most pilots choose to go union, do you find it strange that in Wisconsin after the Act 10 law union membership dropped? Some substantially.

    Have you ever considered people on the right might see government unions as fundraisers for democrats? Looking at opensecrets.org, (top all time donor list since 1989) notice how many unions are listed before a republican leaning donor appears?
    Are you a member of AirLine Pilots Association? #55 on all time donor list, 4 behind the NRA and 5 ahead of Koch Industries. (Makes you wonder why people on the extreme left always whine about political $ from the NRA and Koch when they are so low in the list.)

My point is the gop is grandstanding using vets as props with reince pribus even viwing to pay the salaries of guards so the war monument can stay open while not a peep about WIC, cancer treatments and 800,000 furloughed workers. Every dem I have seen give an interview mentions the furloughed workers.
