Tamir Rice and unarmed white men.

Tamir-riceAnd then there was Tamir Rice. Truly a sad story. Kid playing with a toy gun in the park; there is a 911 call to the po po, and the next thing you know an 12 year old is dead after two gun shots to the abdomen. (Watch)


This case is tragic on so many levels. First, the police officers who are not properly trained. Second, the same police officers who have color arousal issues. Third, the irresponsible parents who purchase toy guns for their children to play with in the first place.


But field, it's not only black children who accidentally get killed by police officers.

I know, little Mexican children get shot as well.

But field what about all the unarmed white men who get shot by black police officers?


Yes, an extremely rare occurrence I am sure. In fact, can think of only two.


Dillon Taylor was not shot by a black man; the police who shot him was Hispanic. But I will concede that his killer was non-white.


Thing is, though, the officer, unlike Officer Wilson in Ferguson and others, was wearing a body camera.


And there was James Whitehead. He was killed by a black off duty police officer after the two men got into an altercation where the off duty officer claimed that Whitehead called him the n-word.


That black officer was terminated and sued to get his job back, and the family of Mr. Whitehead settled a civil suit with the city of Orange,Texas.


Anyway, back to Tamir Rice.


Like the situation in Ferguson, there are some issues all the way around.

"Deputy Chief Ed Tomba said the officer, one of two who responded to a dispatcher's call, was less than 10 feet from Tamir under a gazebo when the confrontation took place He declined to say if the video matches the officer's description of events, saying a full interview of the officer has not been conducted.

Neither he nor Chief Calvin Williams explained why police have not obtained a full statement from the officer.

The boy's family declined to view the video but it was shown to family representatives, Tomba said. Cuyahoga County Prosecutor Timothy McGinty said the video would be released, but did not say when.

The identities of the officers have not been made public. They were placed on three days' paid administrative leave, and will be on restricted duty when they return, police said.

Tomba said the investigation could take three months, after which a grand jury will hear the case to decide if charges are warranted.

Tomba said one officer fired twice after the boy pulled the fake weapon from his waistband but had not pointed it at police. The boy did not make any verbal threats, but he grabbed the replica handgun after being told to raise his hands, Tomba said.

Williams said the "airsoft"-type pellet gun lacked the orange safety tip required at the time of sale and was indistinguishable from a real semiautomatic pistol.
"Guns are not toys," he said. "We need to teach our kids that."

"Who would've thought he would go so soon?" Gregory Henderson, a close friend of Tamir's family, told WKYC-TV. "To be 12 years old, he doesn't know what he's doing. Police, they know what they're doing."

Henderson also questioned why police did not use a Taser-type weapon.
"You shot him twice, not once, and at the end of the day you all don't shoot for the legs, you shoot for the upper body," Henderson said to the Cleveland Plain Dealer.Henderson, identified by that newspaper's website as Tamir's father, said Tamir was a "respectful" young man who minded his elders.

A 911 call to police in which a man says the gun was "probably fake" has added to the controversy.

Jeff Follmer, president of the Cleveland Police Patrolmen's Association, said the officers were not told the caller thought the gun might be fake. He said an officer taking a Taser out when they believe there could be a person with a gun puts the officer at risk, the Plain Dealer reported.

The hacker group Anonymous claimed responsibility Monday for shutting down the City of Cleveland's website after Rice's shooting, WKYC said. The FBI is investigating". [Source] 

I just hope that the officer who shot young Tamir will show some remorse.


Because sadly, the officer who shot Michael Brown certainly did not.

    I see a number of problems with the officers' handling of the call. 1) The officer driving the car approaches the suspect too quickly. 2) The officer places the car and his partner too close to the suspect. 3) The officer exiting the passenger side of the car, being extremely close to the suspect, feels threatened and over-reacts.

    If the officers had announced themselves from a safe distance, instructed the suspect to place the possible gun on the ground, then Tamir would still be alive. As it was, their approach to him gave them little time to assess the true level of threat. I do believe there is negligence to be found here.

    Regarding the Grand Jury Verdict in Ferguson, even Justice Scallia has said it was not justice:

    "On Monday, Prosecutor Bob McCulloch announced that a grand jury had decided not to indict Darren Wilson, the officer who killed Michael Brown. But that decision was the result of a process that turned the purpose of a grand jury on its head.

    "Justice Antonin Scalia, in the 1992 Supreme Court case of United States v. Williams, explained what the role of a grand jury has been for hundreds of years.

    It is the grand jury’s function not ‘to enquire … upon what foundation [the charge may be] denied,’ or otherwise to try the suspect’s defenses, but only to examine ‘upon what foundation [the charge] is made’ by the prosecutor. Respublica v. Shaffer, 1 Dall. 236 (O. T. Phila. 1788); see also F. Wharton, Criminal Pleading and Practice § 360, pp. 248-249 (8th ed. 1880). As a consequence, neither in this country nor in England has the suspect under investigation by the grand jury ever been thought to have a right to testify or to have exculpatory evidence presented.

    This passage was first highlighted by attorney Ian Samuel, a former clerk to Justice Scalia.

    In contrast, McCulloch allowed Wilson to testify for hours before the grand jury and presented them with every scrap of exculpatory evidence available. In his press conference, McCulloch said that the grand jury did not indict because eyewitness testimony that established Wilson was acting in self-defense was contradicted by other exculpatory evidence. What McCulloch didn’t say is that he was under no obligation to present such evidence to the grand jury. The only reason one would present such evidence is to reduce the chances that the grand jury would indict Darren Wilson.

    Compare Justice Scalia’s description of the role of the grand jury to what the prosecutors told the Ferguson grand jury before they started their deliberations:

    And you must find probable cause to believe that Darren Wilson did not act in lawful self-defense and you must find probable cause to believe that Darren Wilson did not use lawful force in making an arrest. If you find those things, which is kind of like finding a negative, you cannot return an indictment on anything or true bill unless you find both of those things. Because both are complete defenses to any offense and they both have been raised in his, in the evidence.
    As Justice Scalia explained the evidence to support these “complete defenses,” including Wilson’s testimony, was only included by McCulloch by ignoring how grand juries historically work.

    There were several eyewitness accounts that strongly suggested Wilson did not act in self-defense. McCulloch could have, and his critics say should have, presented that evidence to the grand jury and likely returned an indictment in days, not months. It’s a low bar, which is why virtually all grand juries return indictments.

    But McCulloch chose a different path."

    This sort of thing is just inexplicable to me.

    To begin with, if it's a kid with a gun, and the 911 caller isn't reporting that he's actually committing a crime with it, shouldn't the starting assumption be that that the kid's most likely holding a toy? That's what I'd be thinking if I were a cop responding to this call: maybe a real gun ... but probably not.

    Starting from that assumption would probably have altered the way the cops approached this situation.

    Also, it's irritating that toy manufacturers still consider it a good idea to make completely realistic-looking toy guns.

    (Full disclosure: I had one myself as a kid -- it was a cap gun made to look like a semiauto pistol, and it fired the spent "casings" out a port in the side, just like a real one. I could probably have successfully held up a liquor store with it.)

    Why even stop with an orange tip? Just make the whole damn thing orange, to avoid any confusion. Sure, kids may not like it as much, but this just isn't a risk worth taking.

Since we are likely to see more tragedies like this, it's important for all of us to be organized and keep our opinion threads orderly. Otherwise, it becomes very confusing. Still others acknowledged changing their stories to fit published details about the autopsy or admitted that they did not see the shooting at all.

    Anyway, let us move on and forget about Michael Brown and the Grand Jury. It's over. Let's move on with this shooting incident that killed another even younger Black kid. Let's talk about this one and get it out of the way so we can move on with the next one....forgetting about the past.

    One of my worst fears is that a little kid will run out into the street in front of my car while I'm driving. I don't think I could live with myself if I killed a kid. It is always tragic when parents outlive their children. But it has to be especially devastating to lose a child at an age when he is still under your wing and around all of the time.

You have no idea what a burden this forbidden word is to white people. My worst fear is that I might say it in my sleep one night. This could be embarrassing if the wrong lady is in my bed. You may not think me serious but you should know I had an uncle who went to an early grave because he could not use that word.     I'm proud that people are marching in sympathy with Michael Brown. I wish they'd march more often, for other reasons, as the Europeans do. Mess with their superior healthcare, their quality affordable childcare or their economic survival and they hit the streets.

    I'm proud of the Atlanta police. As long as marchers were peaceful, they keep out of the way. Marchers claim the window breakers weren't part of their group and wore masks. No one seems to doubt that now though the police may have arrested some of the wrong folks because of isolated violence. Their behavior in difficult circumstances seemed restrained and balanced. People are raising money to help the cabbie whose car window was smashed.

    I'm proud that the Atlanta marchers were a multi-cultural group. As were the restaurant patrons who cheered them on.

    I'm proud that the owner of one of the restaurants damaged also gave his support to the marchers and was pretty much, hey, shit happens in a big crowd.

    There's a monster on the loose. Two homeless men, in different parts of town, were shot and killed as they slept. Riddled with several rounds. The police have reached out to warn "our homeless brothers", seeking them out and telling them to go to shelters or team up with others and be alert to the dangers.

    Of course, Atlanta's not perfect, but it's nice to feel that we have some things to be especially grateful for on this Thanksgiving.

    When I was a lad we did some proper rioting, sent the fascists and the cops fleeing. But not today, it's obvious to me that the rioters of Ferguson can't be trusted to get the job done properly.

    One example: Molotov Cocktails: Fix the petrol soaked rag to the neck of the bottle with wire, otherwise it just comes away as you throw it. Also they are more effective when rained down on your opponents from above, (from the roofs of buildings) rather than lobbed from ground level. I mean that's basic stuff, Rioting 101.

    A few months back, I was at a friend's relatives' home and I noticed their son had an extremely realistic-looking pellet pistol. And the thought did pass through my head that I hoped his parents had warned him to only use that thing in the back yard and not take it out in a busy public area. Wandering down the street with what looks like a real weapon could have a very tragic outcome.

    And that kid was white. For a black kid, sadly, we all know the risk of a terrible misinterpretation is significantly higher. His parents really should have warned him about this.

    All of that said, the primary responsibility for this disaster still lies with the police. It is their job to make some minimal effort to discern whether any threat exists before discharging their firearms. I don't see how anyone can reasonably say they did that.

    ! agree with what you've stated. My boys both had BB rifles as kids. And we were very adamant about instilling the rules of gun ownership to them.

    Especially the cardinal rule that you NEVER POINT YOUR GUN AT ANYTHING UNLESS YOU INTEND TO SHOOT!

    But, obviously that was not done or instilled thoroughly enough in the youngster.

    However. the thing is that so many young black men are getting killed by the preconceived idea that they are wielding weapons, that it somehow seems as though as you stated, because the child was black, the police didn't even make the effort to verify.

    It seems that if it would have been a white child, he would not have been killed.

    Also the dispatcher is VERY much at fault here as she neglected to relay the important information that the caller had stated, "that the gun seemed like a toy" and the caller stated that several times.

    Of course nobody wants to get shot with a BB pellet either, they can cause real injury. But the cops should have verified. And NO he did not look like "a 20 year old" for God's sake!

    If this would have been an isolated incident then it would be different,but given the circumstances and events of late, No.

    It seems the officers enter a black neighborhood and immediately assume it to be as officer Wilson did, "a danger zone". Without stopping to think that although there may be dangerous or mentally ill as in any neighborhood, there are also good,kind, hardworking people living there! And they have to learn to differentiate!!!

    This preconceived notion is erroneous and dangerous.

    My thoughts are that there should be an overhaul of all police forces, because this is crazy!

    My father, a WWII veteran, taught me to shoot a gun at age nine. He also taught me gun safety and never to point a gun, real or toy, at anyone. After trying the real thing, I quickly lost my desire to play with toy guns and I knew never to carry or play with a real gun. Perhaps early introduction to firearms and proper gun education might prevent situations like this.

    However, I do not propose this to suggest parents are to blame for such tragedies. The police bear the grave responsibility for the guns they carry. The police office who killed Tamir clearly misused his weapon regardless of what he thought he saw. He and the officer driving the car are negligent because they did not take the time to assess the threat. I've seen cops over-react in matters as simple as pulling over a speeder. Cops with this tendency should never be allowed to serve. The wielding of lethal force must be done by a calm and deliberating hand, not by cowboy cops like we see in the video. I hope these officers stand trial.

    I have to say that my heart beaks for the parents of these kids that have been killed, they are and will always be suffering an irreparable loss that will never leave them.

    But you know what,I feel bad for the officers involved, because their lives will forever be changed also. But moreso because their hearts and minds are so closed to humanity. A mind is a terrible thing to waste as can be seen by these consequences.

    This is no joke comment. The young man new door came with a wrench and turned off the water. But my house is ruined because the floors are wood. They are sagging now. I have no insurance and my wheelchair will not roll across the wet carpet. I can't believe this has happened to me. I can barely afford my house payments and medicines on a fixed income.     I eat a TV dinner. I have 14 cans of soup and 6 TV dinners left. For this, I am grateful. I have just enough money to get my kitchen pipe fixed. The rest, I won't worry.

    It has been a very hard day. My home was damaged. I have been ridiculed by heartless people and called vicious names. But I am a grateful man. I have only a short time left to live so I suppose I can endure a bit longer these indignities of life. G-d will punish the evil men do. In this I have faith.

I am 87 years old and have attended all of my friend's funerals. This is shy I am alone. You should appreciate you family and friends while you still have them.
