I am not feeling all that much sympathy about Sandra Bland's traffic stop.
Maybe she thought the ticket for an illegal lane change was a little racial profile-y. Maybe it was a bit ridiculous that the dude demanded she put out her cigarette. But her response to this was just over-the-top obnoxious, refusing to comply with his orders, making sarcastic comments right and left.
And, Jesus, all this over a minor traffic ticket? This is what she's gonna take this major "civil disobedience" stand over? Just fucking dumb. I think everyone is feeling bad about her traffic stop in the light of her now being dead -- but in my book, she was 50+% responsible for what went down there. I'm not all that surprised he chucked her in jail. If the cop had "lit her up" with his taser, like he threatened, I wouldn't have felt bad for her at all.
Now, of course, none of that means she deserved to die in jail. We'll have to wait and see what the investigation of her cause of death turns up.
But it's worthwhile to note that her jail intake papers have now been released, in which Ms. Bland admitted that she'd already attempted suicide, in the recent past. Maybe her family really didn't know how serious her mental problems were? Or maybe they're now in denial, out of guilt that they didn't do enough to get her help earlier?
I am of the opinion that the black community as a whole is just not terribly good about acknowledging mental illness. Maybe this has something to do with a communal value around being "strong," or a misconception that psychotherapy is somehow only for white people. Whatever the case may be, it seems there are quite a few black folks out there who are in denial about the fragile sanity of their family members.
I think it was a similar thing with Miriam Carey a year and a half ago. Remember her? Her family apparently had no clue there was anything wrong with her. And yet, for no logical reason, she went bananas and rammed the gates of the White House with her kids in the car, then led the police on a high-speed chase to Congress, where they shot her dead.
Yes, it's true. The black community needs to become sensitive to mental illness. Of all the races in America, they probably need mental help the most, considering centuries of white hostilities of slavery, Jim Crow, lynchings, rape, theft, discrimination, police brutality, humiliation, shame, disrespect and a continuing system of injustices designed to tear down Blacks in order for Whites to feel better about themselves....that's enough to make both Blacks and Whites a little depressed.

So the Sandra Bland dashcam video can be filed directly under "Exactly What I Expected." Take a look here if you haven't seen it yet. Shockingly, the narrative the police pushed bears no relation to what's on the video. There's a half-decent chance this cop will end up fired, but that doesn't really help the person who's dead now.
There are two things every law enforcement officer in this country needs to have explained to them before they work another minute. First, we are not obligated to kiss your asses or be nice to you. There is a good chance that if we're dealing with you, our day has been or is about to be ruined. Assuming we didn't decide to murder someone or rob a liquor store that day, it's likely that you're about to hassle us over some minor infraction – 7 mph over the limit…my god, I'm history's greatest monster! – and hand us a ticket we can't afford now that local governments have decided in the face of declining budgets that law enforcement is an alternate form of tax collection. We understand that there's nothing to be gained by being rude, which is why most of use are curt but not aggressive when dealing with whatever crap you are about to subject us to. We are legally obligated to do very little – to provide identification, not to be violent, to comply with the handful of things you're allowed to ask us to do when we interact. That's it. Nobody cares if your feelings are hurt or if your ego reacts poorly to being treated with an attitude other than meek deference.
Second, we don't have to do things just because you tell us to do them. Whether we smoke a cigarette while sitting in our own car is not under your purview. We don't have to get out of the car when you repeatedly refuse to tell us why we've been detained. There is no law that states that we have to stop doing anything that you might be irritated by or that somehow displeases you. This includes smoking, talking on a cell phone while not driving, and being a black person who doesn't act like a 1930s Hollywood Step-n-Fechit toward anyone with a badge.
Oh, and if we refuse to do something that the law does obligate us to do, that doesn't mean you get to shoot us. That's what the law says. In practice, though, "All that matters is the cop had his feelings hurt and Sandra Bland is dead because she wasn’t nice enough to him." Pretty much sums it up, and unfortunately it happens so regularly now that people are getting numb to it.

It may be a different problem than the murder suspicions that have been thrown at them, but the administrators and staff of the jail are responsible for the safety of their inmates one way or another. They are required to protect inmates from the guards, other inmates -- and themselves.
If she identified herself as having mental issues, and the jail took no additional precautions to address it, that looks really bad for them.
Regardless of the way this shakes out, the county is probably facing at least a civil lawsuit.

Actually, no. I am not happy about the fact she is dead. Regardless of whether it is as a result of negligence about attending to her mental issues or, God forbid, murder, something went very wrong at the county jail.
And I don't believe the officer behaved appropriately in that traffic stop.
But I also find it irritating that people are overlooking her own bad behavior as part of the equation in her getting jailed in the first place. Even if a police officer is behaving inappropriately, you do not have the right to just opt out of cooperating with his lawful orders. The appropriate way to deal with this situation would have been to comply with his orders and pay the ticket. And then, if she objected to her treatment, later lodge a complaint, or hell, hire an attorney and file a lawsuit.
Notwithstanding that some cops are bad, that doesn't imply a blanket right of refusal to deal with them. That foolish attitude of deciding police authority doesn't apply to you because you don't happen to like the cops -- that's what I have minimal sympathy for.

Syracuse, NY - Knockout-- the game a group of teenagers in Syracuse allegedly played that resulted in the violent, random death of a 51-year-old man-- has been a national phenomenon for at least a decade.
Reports of the game have surfaced in Massachusetts, New Jersey and Illinois. In Missouri, a special police squad and prosecutor were assigned to battle the problem. The game there has been characterized in news reports as "almost contagious," with endings that mirror the incident in Syracuse on May 23.
That night, a group of teenagers attempting to knock Michael Daniels out with a single punch wound up beating and stomping him to death, according to police. A 15-year-old and a 13-year-old have been arrested, and Syracuse Police Chief Frank Fowler said more arrests may come.

Like it or not, police officers -- even rude, power-tripping ones -- have near-total legal latitude to order you about during traffic stops. Do not think you can challenge them on this.
If you attempt to assert rights you do not actually have, you are a major dumbass.
Too many people want to blame Ms. Bland, when everybody knows she was a victim of the infamous "Shakedown stop."
That's when the cop appears out of nowhere, swiftly coming up behind you like they're on a call. (This is where white privilege comes into play because a lot of euro's won't know the feeling I'm referencing as they've never felt it.) Now, you have a split second to figure out if you've done something wrong, then you have to look for pedestrians in or on the road, gauge traffic to your left and then right, now in front, next slow down and then pull over to allow the officer to pass.... damn! I forgot to turn on my blinkers!!!
See how easy it is to fall for this sweet money maker? I'll bet that stretch of road is a veritable gold mine. What's even better was that he had found himself an out of state plate, a definite bonus.
Now we can look at the interview. The reference to the driver appearing "agitated" is the 2nd cousin of "reaching for my gun." He has to make sure each step gets on the tape. This is the point at which we begin the escalation. Who doesn't know that they practice these interrogation techniques. However that's where this training is so effective. The officer is trained to give the appearance that it's just about over when, bam they set the hook. Instead of issuing the warning and telling the driver to move on, we see him prolong the moment and move to the driver side to establish a dominant posture standing over her and issuing verbal commands. These orders may seem trivial, but fall into a carefully constructed category involving officer safety. In court, I'm sure he would have testified that he feared for his safety as the lit cigarette could be used to cause him harm. She was still okay here but didn't know that his next command was the game breaker. This is what most people don't know and that's that you are required, at a legal stop to exit your vehicle upon the officers request. All that's left now is to call for backup.
While he lost control of the situation at various points of the stop, I'm sure the court would have backed him up. It's unfortunate that we lost another life to this,a rookie cop.

And yes, I agree they were both perhaps a little too heavily invested in this stop, but can we both agree that this probably wasn't his first traffic stop? That maybe as a professional he would maintain better control? I would think that seeing someone from out of town, maybe he would have extended some of that good old southern hospitality we've been discussing recently.
One question though... didn't he say that he was only going to issue a warning? And even if he did change his mind, why didn't he just issue the ticket and as you say "get the hell out of there?"

ReplyDeleteI am not feeling all that much sympathy about Sandra Bland's traffic stop.
ReplyDeleteMaybe she thought the ticket for an illegal lane change was a little racial profile-y. Maybe it was a bit ridiculous that the dude demanded she put out her cigarette. But her response to this was just over-the-top obnoxious, refusing to comply with his orders, making sarcastic comments right and left.
And, Jesus, all this over a minor traffic ticket? This is what she's gonna take this major "civil disobedience" stand over? Just fucking dumb. I think everyone is feeling bad about her traffic stop in the light of her now being dead -- but in my book, she was 50+% responsible for what went down there. I'm not all that surprised he chucked her in jail. If the cop had "lit her up" with his taser, like he threatened, I wouldn't have felt bad for her at all.
Now, of course, none of that means she deserved to die in jail. We'll have to wait and see what the investigation of her cause of death turns up.
But it's worthwhile to note that her jail intake papers have now been released, in which Ms. Bland admitted that she'd already attempted suicide, in the recent past. Maybe her family really didn't know how serious her mental problems were? Or maybe they're now in denial, out of guilt that they didn't do enough to get her help earlier?
I am of the opinion that the black community as a whole is just not terribly good about acknowledging mental illness. Maybe this has something to do with a communal value around being "strong," or a misconception that psychotherapy is somehow only for white people. Whatever the case may be, it seems there are quite a few black folks out there who are in denial about the fragile sanity of their family members.
I think it was a similar thing with Miriam Carey a year and a half ago. Remember her? Her family apparently had no clue there was anything wrong with her. And yet, for no logical reason, she went bananas and rammed the gates of the White House with her kids in the car, then led the police on a high-speed chase to Congress, where they shot her dead.
How about Jamaica in the Gold Cup.

So the Sandra Bland dashcam video can be filed directly under "Exactly What I Expected." Take a look here if you haven't seen it yet. Shockingly, the narrative the police pushed bears no relation to what's on the video. There's a half-decent chance this cop will end up fired, but that doesn't really help the person who's dead now.
There are two things every law enforcement officer in this country needs to have explained to them before they work another minute. First, we are not obligated to kiss your asses or be nice to you. There is a good chance that if we're dealing with you, our day has been or is about to be ruined. Assuming we didn't decide to murder someone or rob a liquor store that day, it's likely that you're about to hassle us over some minor infraction – 7 mph over the limit…my god, I'm history's greatest monster! – and hand us a ticket we can't afford now that local governments have decided in the face of declining budgets that law enforcement is an alternate form of tax collection. We understand that there's nothing to be gained by being rude, which is why most of use are curt but not aggressive when dealing with whatever crap you are about to subject us to. We are legally obligated to do very little – to provide identification, not to be violent, to comply with the handful of things you're allowed to ask us to do when we interact. That's it. Nobody cares if your feelings are hurt or if your ego reacts poorly to being treated with an attitude other than meek deference.
Second, we don't have to do things just because you tell us to do them. Whether we smoke a cigarette while sitting in our own car is not under your purview. We don't have to get out of the car when you repeatedly refuse to tell us why we've been detained. There is no law that states that we have to stop doing anything that you might be irritated by or that somehow displeases you. This includes smoking, talking on a cell phone while not driving, and being a black person who doesn't act like a 1930s Hollywood Step-n-Fechit toward anyone with a badge.
Oh, and if we refuse to do something that the law does obligate us to do, that doesn't mean you get to shoot us. That's what the law says. In practice, though, "All that matters is the cop had his feelings hurt and Sandra Bland is dead because she wasn’t nice enough to him." Pretty much sums it up, and unfortunately it happens so regularly now that people are getting numb to it.

It may be a different problem than the murder suspicions that have been thrown at them, but the administrators and staff of the jail are responsible for the safety of their inmates one way or another. They are required to protect inmates from the guards, other inmates -- and themselves.
If she identified herself as having mental issues, and the jail took no additional precautions to address it, that looks really bad for them.
Regardless of the way this shakes out, the county is probably facing at least a civil lawsuit.
I haven't heard anything about the knockout game for over a year. Are negroes still trying to take over the country one knockout at a time or what? I'm scared because even Sean hannity doesn't mention this game anymore. Please Field, be a good guy and help us out with a daily update of the knockout game. I haven't been able to leave my house for years for fear of being knocked out.

Actually, no. I am not happy about the fact she is dead. Regardless of whether it is as a result of negligence about attending to her mental issues or, God forbid, murder, something went very wrong at the county jail.
And I don't believe the officer behaved appropriately in that traffic stop.
But I also find it irritating that people are overlooking her own bad behavior as part of the equation in her getting jailed in the first place. Even if a police officer is behaving inappropriately, you do not have the right to just opt out of cooperating with his lawful orders. The appropriate way to deal with this situation would have been to comply with his orders and pay the ticket. And then, if she objected to her treatment, later lodge a complaint, or hell, hire an attorney and file a lawsuit.
Notwithstanding that some cops are bad, that doesn't imply a blanket right of refusal to deal with them. That foolish attitude of deciding police authority doesn't apply to you because you don't happen to like the cops -- that's what I have minimal sympathy for.

Even if a police officer is behaving inappropriately, you do not have the right to just opt out of cooperating with his lawful orders. The appropriate way to deal with this situation would have been to comply with his orders and pay the ticket. And then, if she objected to her treatment, later lodge a complaint, or hell, hire an attorney and file a lawsuit.
Notwithstanding that some cops are bad, that doesn't imply a blanket right of refusal to deal with them. That foolish attitude of deciding police authority doesn't apply to you because you don't happen to like the cops -- that's what I have minimal sympathy for.

Like it or not, police officers -- even rude, power-tripping ones -- have near-total legal latitude to order you about during traffic stops. Do not think you can challenge them on this.

That's when the cop appears out of nowhere, swiftly coming up behind you like they're on a call. (This is where white privilege comes into play because a lot of euro's won't know the feeling I'm referencing as they've never felt it.) Now, you have a split second to figure out if you've done something wrong, then you have to look for pedestrians in or on the road, gauge traffic to your left and then right, now in front, next slow down and then pull over to allow the officer to pass.... damn! I forgot to turn on my blinkers!!!
See how easy it is to fall for this sweet money maker? I'll bet that stretch of road is a veritable gold mine. What's even better was that he had found himself an out of state plate, a definite bonus.
Now we can look at the interview. The reference to the driver appearing "agitated" is the 2nd cousin of "reaching for my gun." He has to make sure each step gets on the tape. This is the point at which we begin the escalation. Who doesn't know that they practice these interrogation techniques. However that's where this training is so effective. The officer is trained to give the appearance that it's just about over when, bam they set the hook. Instead of issuing the warning and telling the driver to move on, we see him prolong the moment and move to the driver side to establish a dominant posture standing over her and issuing verbal commands. These orders may seem trivial, but fall into a carefully constructed category involving officer safety. In court, I'm sure he would have testified that he feared for his safety as the lit cigarette could be used to cause him harm. She was still okay here but didn't know that his next command was the game breaker. This is what most people don't know and that's that you are required, at a legal stop to exit your vehicle upon the officers request. All that's left now is to call for backup.
While he lost control of the situation at various points of the stop, I'm sure the court would have backed him up. It's unfortunate that we lost another life to this,a rookie cop.
This is my theory. And for you low status euro's who want to know how it's the ebil (sp?)white Debil's(sic)fault it goes like this. They do it to you, too! And you lay down and don't say a word.

99.999% chance he just wanted to give her a ticket and get the hell out of there. His short temper combined with her total unwillingness to follow orders is what led to this situation escalating into them tussling and her getting arrested.

You make some very good points. You are absolutely correct,there is a lot we don't know. And I agree that he probably didn't intend for things to get so far out of hand.
And yes, I agree they were both perhaps a little too heavily invested in this stop, but can we both agree that this probably wasn't his first traffic stop? That maybe as a professional he would maintain better control? I would think that seeing someone from out of town, maybe he would have extended some of that good old southern hospitality we've been discussing recently.
One question though... didn't he say that he was only going to issue a warning? And even if he did change his mind, why didn't he just issue the ticket and as you say "get the hell out of there?"
