Their law, and their order.

TWEET METhe following is the last article you will see by David Frum on this site. We are not exactly ideological soulmates, but when it comes to the dangers of this presidency we have found some common ground.

"Yesterday afternoon, Attorney General William Barr appeared on ABC to demand that President Donald Trump quit making him look bad. Trump’s tweets, the attorney general said, “made it impossible to do my job.” Barr has been intervening in cases in ways that work to protect the president. Those interventions become much more difficult when the president demands them—rather than trusting Barr to know what to do without being told.

At the law schools of the 1970s and ‘80s, a militant faction of professors taught a harsh lesson. Law, they argued, is a myth that property owners invoke to protect themselves and oppress those without property. The legal reasoning that we students were so frantically working to absorb was in fact a deception, an expensive drapery concealing the brute realties of political and class power.
Some students indignantly rejected this teaching. Others accepted that it contained some truth, mixed with much exaggeration and propaganda.

But young William Barr—George Washington University Law School, Class of 1977—seems to have absorbed the radical message with perverse enthusiasm: Alrighty then! Let’s do it!
As attorney general, Barr has focused on two missions: on the one hand, cracking down on crimes by the poor and the foreign-born; on the other, going easy on the crimes of President Trump’s associates. This administration likes to call itself “tough on crime” and to revile its Democratic opponents as “the party of crime.”

But toward its own many crimes, the Trump administration is genially indulgent. Like the gangsters around the table in the first Godfather movie, the Trump administration is able to convince itself that its victims are animals without souls—and that its own lawbreaking is a necessary, even honorable, accommodation to the facts of life. “The real crimes were on the other side!” Donald Trump tweeted after he heard the news of Roger Stone’s recommended sentence of seven to nine years—exactly in line with federal sentencing guidelines for Stone’s convicted offenses.
As attorney general, Barr has delivered a series of speeches about the importance of sternly enforcing the law against lower-class people. In a February 11 speech to county sheriffs, he warned against officials who refuse to comply with police work:

Another similar problem is the increasing number of district attorneys who have fashioned for themselves a new role of judge-legislator-prosecutor. These self-styled “social justice” reformers are refusing to enforce entire categories of law, including law against resisting police officers. In so doing, these DAs are putting everyone in danger.
In a November lecture before the Federalist Society, Barr argued that issues of police motive or bias are irrelevant to the enforcement of law against ordinary people:
The Supreme Court has traditionally refused, across a wide variety of contexts, to inquire into the subjective motivation behind governmental action. To take the classic example, if a police officer has probable cause to initiate a traffic stop, his subjective motivations are irrelevant.
In an October talk to Department of Justice employees, Barr spoke of the hardships endured in the pursuit of justice: “the long absences, the ever-present awareness of the risks.” But those hardships, he said, are required to sustain “a society where the law will be enforced and your fellow citizens will be protected.”

At the same time as Barr was pronouncing these stern words, however, he was also shrewdly rejiggering his department to enable him to do special favors for criminals of the highest rank.

When Barr was confirmed as attorney general on February 14, 2019, the Trump presidency faced two imminent prosecutorial threats: Robert Mueller’s special-counsel investigation and the office of the U.S. attorney for the District of Columbia. Barr promptly moved to neutralize both.
First, he attacked Mueller. He took early possession of the Mueller report and held it for almost a month while publicly mischaracterizing its findings. Four weeks after the report’s release, Mueller resigned and Barr closed the special counsel’s office, moving all its remaining prosecutorial work to the U.S. attorney for the District of Columbia.

That office was headed by a prosecutor independent of the Trump administration, Jessie Liu. Liu was then deftly moved aside. In December, President Trump nominated her for an important job at the U.S. Treasury. Liu resigned on February 1. To fill Liu’s place, Barr turned to one of his closest aides, Timothy Shea, who was appointed to head the office on an interim basis. Once Shea was installed, Liu’s nomination was withdrawn.

That has produced a remarkable result. Barr and Trump have tightened their control of the U.S. attorney’s office without Senate questioning of either the outgoing or the incoming U.S. attorney for the District of Columbia.

These maneuvers have enabled Barr to bestow leniency upon Trump cronies convicted of crimes.[The entire article is here.]

When Americans finally realize that there has been a total takeover of the institutional norms and the rule of law in America, it will be too late. It happened before (See the civil rights struggles of the fifties and sixties.), and it will happen again.

    Before his confirmation as US Attorney in December 2017, Brady was the head of litigation for Federated Hermes, a Pittsburgh-based investment firm. He’d also taught constitutional law at the University of Pittsburgh and served as an assistant US attorney in Pittsburgh from 2004 to 2010. Prior to that role, he clerked for Thomas Hardiman, a federal appeals court judge who was reportedly on Trump’s short list for the Supreme Court ahead of his selection of Brett Kavanaugh.

When asked about Barr’s arrangement with Brady, a spokesperson for Sasse confirmed to Mother Jones that the two are friends dating back to college, “but the first he heard about it was when the news broke.”

  17. Some folks are wondering what will happen with the DOJ when the shoe is on the other foot.
    It's apparently a complicated issue when you are considering the prosecution of previous administrations, and I understand that. The use of the criminal justice system against one's political opponents is definitely some banana republic shit.
    But I still contend that the lack of consequences for Republican presidential misbehavior is a big factor in how we got this far away from the observation of the rule of law. Nixon was pardoned. Reagan was never tried for Iran/Contra. George W. Bush and his crew may have travel restrictions, but otherwise tortured with impunity.
    Why should any other Republican president believe he would face any consequences for his behavior? What Republican crime could rise to the level of "must be reined in" if torture didn't?

    Is that really even the case?

    If any foreign government genuinely attempted to prosecute Dubya or anyone from his administration for having launched the Iraq War or (legally, far more plausibly) having authorized indefinite detention and torture of accused terrorists, all hell would break loose.

    Realistically, I don’t think any government would do it, for fear of starting a war with the US that would ravage their country. Defending the human rights of random Arabs simply doesn’t rate highly enough to incur that kind of risk.

    And don't forget water boarding, which was the Cheney choice for torture is a violation of international laws and the Geneva Conventions and is also allegedly illegal in the US.

    The US isn’t a signatory to the treaty that created the International Criminal Court at the Hague, and doesn’t recognize its authority over US citizens. Any country that sent one of the Bushies to the Hague would be regarded by the US as having committed a kidnapping, which would likely be seen as an act of war.

    I know that a lot of people on the left wish it were not so, but this is the reality.

    Unemployment sat at 4.5% when drumpf was appointed and the needle has barely moved 1% down. It went down 5.5% under Obama. Stock market grew by 150% under Obama. Barely a third f that under drumpf.

    And yet, curiously, the government have dropped all charges against him! That must be because they’re such nice guys and they were showing compassion for McCabe. After all, that’s what the Trump administration are known for, being such sweet, super-nice guys. It couldn’t possibly be that they’ve falsely accused someone. Again.

    Oh, and McCabe’s wrongful termination lawsuit is still active.

    Tell me, why is it that everyone Trump says is a bad guy, mysteriously keeps getting exonerated, while Trump keeps having to pay off the people who sue him, and all of his friends keep going to jail? Could it be that the wingnut media stories you have consumed have “lacked candor”?

    Seriously? A Yale grad, a district attorney, private practice attorney then circuit court and appeals judge. THAT'S not qualified?     "The most consistent concern expressed by those advising President Obama was that Sotomayor, although an able lawyer, was “not that smart and kind of a bully on the bench,” as one former Second Circuit clerk for another judge put it. “She has an inflated opinion of herself, and is domineering during oral arguments, but her questions aren’t penetrating and don’t get to the heart of the issue.”

    Terry V Ohio was a long standing SCOTUS decision that dealt with this and the problem is negroes do not like obeying laws. if a cop stops you and asks what you are doing inform them of your activities and produce ID and you will on your way in 5-10 minutes if you did nothing wrong.

I was also told that the Chief's daughter was seen hanging out with said celebrity during the NBA weekend...

    There's no evidence of any US policy decisions under Trump that have been taken to further Russian interests. Trump has been much more adversarial with Putin than Obama was. So by your logic, was Obama a Russian plant? Remember his 2012 hot mic moment with Russian president Dmitry Medvedev:

It is disgusting that he is allowed to spend apparently infinite amounts of money trying to bamboozle voters into believing he is Obama the Second.

    I know Obama himself has, wisely, tried to stay out of the primary race, but it might be time for him to step up and say, “No, fuck this guy. He’s a right-winger. DON’T vote for Bloomberg.”

    Endorsing a candidate at this juncture is probably a bad idea, but a well-placed anti-endorsement of Bloomberg would be quite sensible.

    I didn't mention Clinton in my post, so I could not have misspelled his name. But speaking of Clinton, Bill ran for office for the last time in 1996. Juanita Broaddrick's claim that Bill Clinton raped her did not become known nationally until 1999 after he had been acquitted by the senate.
    Bill Clinton did not run for any office after the accusation became known. So no one voted for a known rapist. But a whole bunch of Republicans are planning to vote for known, serial rapist come November.

The United States also had no duty to intervene, given Ukraine is not part of NATO and doesn’t benefit from its Article 5 (or “collective defense”) protections.
