Above the law?

 


The thing you have to understand about the legal system in America is this: Yes, it's fundamentally a fair system, and it probably has no equal anywhere else in the world. But sadly, we have to be honest with ourselves and acknowledge its flaws. 

We tend to selectively prosecute for certain crimes in this country. Often who gets prosecuted will depend on their wealth, level of influence, and their social connections and political clout in their community.  

I think you all know where I am going with this. 

There is a fellow down in South Florida who lives in a very large estate, and who used to have a game show on television. This fellow should probably have been indicted for some very serious crimes by now. Honestly, after all we have seen and heard over the past few weeks, most of us of sound mind are wondering why the former game show host has not been charged and arrested. 

I agree with Glenn Kirschner. 

"Ex-prosecutor Glenn Kirschner said Trump should be arrested "promptly" in light of the Mar-a-Lago search.

The FBI recovered dozens of empty folders marked confidential or containing instructions to return the contents to an aide.

"Did he sell them to America's adversaries? Did he use them to blackmail people?" Kirschner asked.

In the probe, investigators recovered nearly 100 empty folders, according to a detailed inventory unsealed and released by the Justice Department. It's unclear where the contents of each empty folder are.

Kirschner, speaking in an episode of his YouTube channel, questioned whether Trump might have sold or given away some of those classified government documents. 

'The most reasonable inference is that Donald Trump disposed of those classified documents after unlawfully taking them from the White House," Kirschner said. "To what purpose did he put them? Did he sell them to America's adversaries? Did he use them to blackmail people? Did he use them to leverage a favorable business deal in some country or another? We don't know yet.'"

True, we don't know all the details yet. But we know enough to know that the former game show host broke the law. And if he was just a another "normal" citizen like most of us, he would be talking to his lawyers about the best way to stay out of prison for a long time. 

This is what a former federal employee, James Turnage, wrote about the theft of classified docs: 

"The removal of secret documents from the protection of the United States federal government is a crime punishable by fines and imprisonment. Trump stole 15 boxes of documents when he was removed from the White House, many of which were classified. This author was a federal employee for about two years and was told that if anyone violated the oaths of office, they could receive a punishment that could include a 25,000 dollar fine and 10 years in federal prison.

This author asks Trump supporters included, “if anyone violates federal law, should he or she be allowed to run for office?” Many believe that Trump’s theft of classified documents combined with his close relationship with Vladimir Putin should be treason.

How many times will this government, most importantly the Department of Justice, allow Trump to commit acts of sedition and irrefutable treason before he is tried for the ultimate crime against this nation?

On Friday, it was confirmed that the 15 boxes of federal documents stolen by Trump, and recovered in Mar-a-Lago, contained multiple documents containing national secrets. If this had been discovered as an act by anyone other than a disgraced former president, this individual would have been charged with the highest crime against the United States of America."

No one should be above the law, but this is America, and old habits are hard to break.

    This is bullshit.  The POTUS has unlimited authority to declassify documents.  It doesn't matter how the documents are originally marked, if Trump took it home he implicitly declassified it.

    Most of that stuff probably pertains to the fraudulent Steele dossier and the "RUSSIA RUSSIA RUSSIA" hoax.

  2. Perhaps if Ford hadn't pardoned Nixon, or if Reagan hadn't skated on Iran-Contra, or G.W. Bush hadn't gotten away with torturing people, Fergus would stand a better chance of receiving justice for his crimes. Somewhere along the line someone decided that Republican presidents just don't get prosecuted for their crimes, and we're still living with that.
    Above anon: declassifying is one thing (that he did not do or there would be a record of it) but stealing government property is an entirely different matter, and he was caught dead to rights with the stolen documents, after ignoring a subpoena requesting their return and lying to the government about that.
    This is sort of important, like the assault on democracy his fans are waging is important, and how it gets resolved will impact what kind of country we get to live in going forward.
    I predict that very few people will be satisfied by the outcome, and note that liberals have been warning that something like this was inevitable if the goddamn Republicans aren't reined in politically for many years now.

" The POTUS has unlimited authority to declassify documents." 1) The Individual in question is not the POTUS anymore, seems like that Brandon fellow you all despise with 10000 suns has had that job for a hot minute. 2) Declassifying documents is a thing the current POTUS can do, but it requires paperwork and a process. It does not work like a magic wand, it cannot just happen in someone's mind or implicitly. There is a record of what is declassified.

    First, Trump is no longer POTUS. His term ended on January 20, 2021. Btw, there are top secret documents that even a POTUS cannot declassify. Second, there is a process for declassifying documents that even POTUS has to follow. Third, even if he declassified them. THEY DON’T BELONG TO HIM OR ANY OTHER GOVERNMENT EMPLOYEE OR FORMER GOVERNMENT EMPLOYEE, NO MATTER WHAT THEIR TITLE IS! The documents are government property and belong in the archives. Some classified documents come in a briefcase with a lock on them. There is a room where classified documents are viewed that is isolated.

    When someone becomes a government employee, no matter who they are, they’re given a manual with rules and regulations to read. There is a section in it that explains the rules, regulations, and protocol regarding government documents. After you’ve read it, you’re given a document to sign stating you’ve read and understood what you’ve read. Before you sign it, you’re given a chance to ask questions if there is anything you don’t understand or that isn’t clear to you. It goes in your personnel file. Therefore, there is no excuse.

    Also, Trump had help. He didn’t get those classified documents all by himself. Nope. Those are not documents that you’ll find sitting on top of people’s desks. However, I’m sure whoever that was will come to light in the investigation. Thank God for surveillance cameras and all sorts of technology. Kushner, Nunes, Marco Rubio, Kashyap Patel, and Ezra Cohen are on my list of suspects.

    If you wish to remain in Lala land, that’s your choice, regardless if it’s unrealistic, moronic, or delusional. Nevertheless, the Steele document wasn’t a fraud. Trump’s collusion with Russia wasn’t a hoax.

  17. California has enough battery storage linked to its power grid that it averted rolling blackouts during last weeks heat wave. Battery linked solar power in California is now less expensive than any fossil fuel based energy, and more battery capacity is being added all the time.

    The batteries are also evening out the costs of energy for users by recharging during the lower cost mid day and discharging during the higher cost evening.

    My main question for California’s energy plans has to do with recent efforts to ban natural gas in new homes, restaurants, etc. I’m pretty skeptical about the ability of California utilities to replace this lost energy source with electricity ON TOP OF the additional electricity already needed for the switchover to electric vehicles AND the need to spend money buring more of their power lines so as not to start wildfires.

    It’s a lot! Can they feasibly do all of that simultaneously? From the outside, it looks way too ambitious and risks failure. PG&E, for example, is already broke.

    Dealing with global warming is urgent, but … you’ve still got to keep the lights on.

Yes, we will have to make major changes, like everyone who uses electricity will, the difference being that we are actually doing those changes right now, and thus will be a decade or so ahead of the curve when it comes to getting away from fossil fuels, which is inevitable.

    Well, that’s the operative question, though. Can these changes actually be made as fast as California is trying to make them? Do the plans add up? It’s not only a matter of spending more money, although that will be a factor. There are some finite resources that will impact whether the goal is achievable. There are only so many engineers and technicians available to run the transmission lines and build substations, to set up new generating capacity. There may be scarcity of needed parts, organizational challenges in managing many projects at once. Et cetera.

    The bottom line is that there will be limits to how fast one can expand the grid to supply more green electricity— or any type of electricity at all, really.

    I guess we’ll all see in a few years whether they can pull it off, or whether some major U-turns are coming.

    I don’t think it’s any kind of a sinister plot. It’s just the Democrats are employing a strategy called “not trying very hard” in South Carolina.

    The Democrats have ranked which contests they think they can win, and decided that South Carolina is a long shot, so they’re really not devoting any meaningful resources or effort to winning there. They’ve sort of written it off as a lost cause, a redneck paradise that will be way too hard to prize it out of the iron grip of the Republicans.

    Inevitably, the Democrats have to do some of that prioritizing. They don’t have unlimited resources. But there is an argument to be made that they have overprioritized winning the blue states, and are over-reliant on their core, loyal constituencies of POCs and urbanites, and they aren’t making enough of a play for some other constituencies. Basically, they are leaving potentially winnable seats on the table.

    So, like, probably South Carolina isn’t winnable and I can’t blame them that much for not giving up there, but it’s pretty inexcusable that they’ve recently let the GOP punk them so bad in places like Wisconsin or Florida. There just is no good excuse for why Dem organization is so bad in those places that you had someone like Scott Walker able to conquer Wisconsin a few years back, or a complete maniac like DeSantis running Florida. Those states have lots of liberals in them and the Dems would have a shot there, if they ever got their act together.

    I don’t think that’s true. Given the choice between a white liberal and a Republican “good Negro” — one who will lecture others in his community that racism is over and they just need to pull up their sagging pants, stop being lazy, and stop resisting the police — many racist voters will choose the Republican. As long as they feel they can trust the Republican not to suddenly have a change of heart and transform into Malcolm X.

    Tim Scott largely fills that bill. And if white racist voters ever feel he doesn’t, they’ll get rid of him by replacing him with a white wingnut in the Republican primary, not a white liberal in the general election.

    The Democrats can’t take back Southern states by just running more white candidates. Winning will require more than that. And many of them just aren’t winnable at all. But surprisingly, some are. As a result of recent demographic shifts (people moving to those states from other parts of the country), Virginia and Georgia are now in play, and the Democrats are fighting for them.

    And after more than 50 law suits, do you know of any fraud in the 2020 election? The only fraud found involved a few Republican men who voted in the name of dead relatives.

  53. Funny, but I'm still alive and kicking, haven't had covid, and didn't really even have any side effects. Part of that is the vaccines, and the rest is my behavior. I still wear an N-95 indoors with people I don't know (at the grocery store and such) and avoid crowds, mostly. Which isn't hard when you live out in the boonies like I do. I would have had to employ a different strategy had I been living in Oakland during the pandemic, but as luck would have it, we moved out here in the sticks in December of 2019.

    How dumb are wingnuts, actually? Sending desperate people to places there are no resources to care for them is obviously both childish and cruel. And the stunts are dishonest on top of that. They are predicated on the premise that "blue states don't understand the burden border states are shouldering because of immigration." But everyone knows it's not about "burdens"; Republicans are just fucking racists who hate brown people and want them out of the country.

    Finally, all of that is besides one extremely important point: DeSantis has no legal authority to do any of this. Immigration is entirely in federal, not state jurisdiction. So when DeSantis grabs migrants and moves them around the country, against their will and without regard for their welfare or how this will impair any asylum claims they might make, that's interstate kidnapping, which is -- surprise! -- a federal crime.

    These stunts probably won't continue past the general election, but if they do, if DeSantis sends out another migrant transport on Nov. 9th, then on Nov. 10th, Biden should respond by sending the FBI to arrest DeSantis and toss him in the slammer.

Not only was the stunt cruel and stupid, but in Massachusetts there's a law granting immigrants who are victims of crimes special "U" visas, with which they can't be deported while their case is being heard. Such cases can take up to seven years to resolve, so the entire "ship them as far away from their immigration hearing as possible to get them immediately removed for missing it" sort of blew up in their ignorant faces.
    Some day we won't have to rely on Republican incompetence to bollix their atrocities, but until then I'll take it when I can get it.
    And their "blue states don't want immigrants either" bullshit doesn't fly here in California...

    How have I only just heard about this? Given the absurdity of the following incident, which happened 7 years ago, it really ought to have made bigger headlines.

    Fox "News" is a horrific joke of a media outlet, but sometimes the stupidity of the on-air people even exceeds the normal, awful expectations for one of their shows. One spectacular example is the Fox and Friends segment in which they decided to have their presenters engage in throwing axes at a target in a heavily populated urban area.

    Even a typical grade-school kid would be able to spot the potential for disaster here, but apparently not Fox producers. Naturally, an axe missed the target and nailed a member of a marching band practicing nearby, and his lawsuit against Fox is still ongoing in court.     Which only proves that YOU DIDN'T WATCH THE VIDEO.  The video is of President Trump in front of a helicopter declaring that he'd declassified EVERYTHING related to the hoax, which could have come to millions of documents.

    If covering a news conference is "right bias", all it means is that you cannot understand anything contrary to your Narrative even if it's right in front of your face.  To call that a mental disability is an understatement.
