Congress technically did cede A BIT of this taxation power to the president when they wrote various tariff laws. However, all of these tariff laws were limited in scope. As in, they can only be used under very specific circumstances, in specific ways, and on a temporary basis. Basically, they are emergency tariffs.
Where Trump’s lawbreaking comes in:
1) There is no emergency; Trump is simply declaring anything he happens to dislike to be an emergency. Which is bullsh*t. That’s what dictators do.
2) Trump is imposing these tariffs in a totally unlimited way. “I AM GOD-EMPEROR TRUMP! TARIFFS ON EVERY NATION, FOREVER!”

The reasons for this massive increase in bankruptcies should not be a surprise to anyone. They include lost markets due to Trump's illegal tariffs and ballooning costs due to Trumpflation. Everything a farm needs to operate jumped in cost, but farmers weren't getting nearly enough back to meet their costs.
Another factor adding to the farmers' woes was the labor issue. With fewer migrant workers, labor costs rose, squeezing farmers even more.
In Trump's first term, his tariffs and his war on immigrants caused Wisconsin dairy farms to close at a rate of two per day. To do the same thing and expect different results is the definition of insanity - or in Trump's case, dementia.
Unsurprisingly, experts are warning that 2026 is going to be more of the same, only worse.

Actually, I take that back. It might not even be necessary for the importer to prove they didn’t pass the costs along. Which means the importer could have forced American consumers to pay the tariffs, and then still turn around and demand them back from the federal government for a windfall.
And it might not be just American companies like Costco doing it. Foreign importers could also be raking it in. The final result of all the litigation could be that American consumers not only got stuck paying Trump’s dumb tariffs, but ended up paying them to Chinese companies!
